Mueller faces ‘unique hurdles’ if he wants to press obstruction case against Trump

Special counsel Robert Mueller could have a tough time making an obstruction of justice case stick against President Trump, according to legal analysts, who said he will have to overcome a number of “unique hurdles” — not the least of which is a decades-old Justice Department ruling that a sitting president can’t be charged.

Analysts say it will be up to Mr. Mueller to decide whether to accept the long-standing opinion of the Office of Legal Counsel, which ruled in 1973 and again in 2000 that a president has immunity from criminal prosecution.

It’s also not clear that FBI investigations count as “proceedings” that could be obstructed under one of the legal statutes that might be cited in an obstruction case, according to a legal memo prepared last month by the Congressional Research Service.

“Courts have not reached consensus on whether an FBI investigation meets this standard,” the report says of ...

The president commands the executive branch. The executive branch prosecutes crimes. When it comes to prosecutorial discretion, therefore, the president's word is the last word!

Don't like it? Fine. You need a majority of the House and two thirds of the Senate to do anything about it.

This article is about CHARGING him for a crime and facing prison time, etc.

Too outlandish? Not at all.

We can’t even get the silly inquisition STOPPED.

That pos Warner and MOST republicans and dems want Trump out!!

Everyone needs to fire a letter to their congressmen that the witch hunt needs to end NOW!!

Or they will lose their cushy government jobs.

I hope you are correct, Jack Hammer.
I fear, though, that it is more sinister than that.
I believe Trump ran smack into the entrenched bureaucracy and elitist mindset that has evolved in DC over the last 100 years.
I believe both sides of the aisle are so intertwined as to be indistinguishable, one from the other, at any functional level of FedGov.
And, I believe they see in Trump the makings of their own demise. And, they are fighting hard to destroy him and his administration.
Witness their move of focus from Trump, himself, to his direct aides (Kushner, Conway, his kids, et al). Certainly, they will come back to Trump. But, they will put heat on anyone close to him while they probe for the weak spot in his own armor.
This is sickening to watch, to witness the destruction of our history, our values, this grand experiment as a direct result of their seething hatred of this man and what he was elected to accomplish on behalf of the American people.
I fear for the future of this once great nation...

I’m very sorry to say Trump was the GOP’s last hope and they are finished. This is the real public assassination, not some Shakespeare in the park. How many of us are cursing the GOP in our hearts. New tell me that base will support these traitors. Not going to happen.

Do not fear. Turn to the ancient Scriptures of the Bible, even if you are not a believer, to see what happens to evil men and women who hate and plan mischief to try and destroy others. Human nature is well defined in those scriptures and it never changes. War is based on the lust for power, and enslavement of other human beings, mostly for sex and the pleasure of brutality inside the hearts of those people.
At present, however, there is increasingly a large portion of this population which is still ready to die to prevent the demise of America and the idea that people can be free from the kind of evil which is trying to shape up all around us, and especially in NYC and California, the dense population centers which are NOT representative of America herself. The “salt of the earth is still here,” and a couple of them are still recuperating in a hospital still with fragments of an assassin’s bullets inside their bodies. We clearly see the corruption in the fake news which has been fed to us ever since this President came on the scene. He is a major threat to the 100 years of progressive efforts to enslave and steal this nation for the purposes of pure evil against the common people. Donald Trump does not have to compromise with their evil, which, frankly, is beginning to look far worse than anything the Russians have tried in recent history, for their (deep state) efforts are secret and hidden, which is why they are called the “deep state.” If these forces of evil entrenched inside our government and media do not cease their “witch hunt” they will provoke Civil War and they will not win. Trump reminds me a lot of Churchill, who was similarly treated in his day for standing against Hitler and the Nazis. Some of the very young reporters who are taking part in very bad things should read about Churchill. There is nothing new under the sun, including the courage of most people who do not want evil to prevail. Do not fear. God is still in control and the prayers of His people do count.

Yep. The aim is prosecution and impeachment. GOP is in on it. I’m sure they are all blackmailed. You are witnessing cowardice and treason. If we’re honest we know we hate the GOP, they are done. I was once one of those pragmatists voting for them.

One possible play...they go after Kushner. There is plenty to look at..starting with allegation he wanted to use russian scif to avoid US intelligence.

They Hope trump does something stupid to protect ivanka and her husband. Then they Impeach

This is a coup attempt and it must be stopped. Mueller is fatally compromised and if he won’t resign, he should be removed. If this proceeds and Trump is removed, it should light the fuse on a nationwide rejection of the DC cabal that will not allow the voters to govern themselves.

What both parties are doing to Trump and his administration is simply this:

It’s a message to anyone in the future who is not a politician to ever dare again think they can run for President and win and not have your life “targeted” every day of your Presidency.

Yes Trump was our last hope- the democrats, socialists, even communists employees have been planted so deep in major departments of our government (State Dept, FBI, CIA) that it is almost impossible to “clean it out totally”.

This article at least suggests a good fundamental question.

Why would Mueller take on a case that compromises the whole enchilada? He has an assignment (in writing) to looking into the cases Comey alluded to in open testimony before the House, on March 20. Obstruction by Trump is -not- in that group of cases.

He wouldn't! He'd let his nominal superior, Rosenstein, know that taking that case opens up a "conflict of interest" can of worms. Mueller and Rosenstein would see eye to eye on this point, neither has an interest in making the SC process messy or extended.

There is another angle. Sessions is recused from Trump campaign stuff, not "everything Trump." And the obstruction accusation is post-election, even post-swearing-in, and so has nothing to do with the campaigns. What I am leading up to is that Sessions is not recused from investigating or prosecuting a claim that Trump obstructed justice. Sessions may want to appoint a SC to look into obstruction, but Sessions is not recused from obstruction.

The press and deep state want you to assume collusion and obstruction necessarily merge into one investigation. I call bee-ess on that.

I predict Mueller won't have anything to say about the accusation that Trump obstructed justice, other than it is not in his scope of review -- and he'll explain why it is not in his scope of review.
