FBI refuses to release Comey memos while investigation ongoing

The FBI won’t be publicly releasing any memos that ousted FBI director James Comey wrote about his conversations with President Donald Trump because they might interfere with an ongoing investigation.

The Hill made requested those memos, citing open records law, on May 16, the day a New York Times report revealed their existence.

Those documents, however, fall under a part of the law that allows agencies to withhold records if they have been “compiled for law enforcement purposes, but only to the extent that the production of such law enforcement records or information... could reasonably be expected to interfere with enforcement proceedings,” according to a letter the FBI sent to The Hill.

Comey told a Senate panel that he wrote the memos recapping conversations with Trump because the longtime FBI director was “honestly concerned that [the president] might lie.”

The memos reportedly include a description of one private conversation with Trump when he allegedly asked Comey to end an investigation into former White House national security adviser Michael Flynn, who had been fired for allegedly misleading the vice president about his contacts with the Russian ambassador, according to the Times report.

“The records responsive to your request are law enforcement records,” the FBI said in its denial. “There is a pending or prospective law enforcement proceeding relevant to these responsive records, and release of the information… could reasonably be expected to interfere with enforcement proceedings.”

They are going to be leaked anyway.

Might as well stay ahead of the curve.

If there is anything remotely damaging to Trump, it will definitely be leaked. If not...well...the old saying “ The dog that didn’t bark” applies.

Like Rubio said during the AG Sessions hearings, “the ONLY thing that hasn’t been leaked is that President Trump wasn’t under investigation”. So, if the memos can potentially hurt Trump, they WILL be leaked. They’re holding them until they feel that they have a gotcha moment to try to contradict him.

If I write a memo to myself claiming that Chuck Schumer punched me in the nose, does that make the accusation become absolute fact?

The more they talk about these stupid memos, the more they convince themselves they're something more than just Comey making an accusation. It's still simply his word vs. Trump's word as to what was said in private to Comey by Trump. I don't care if Comey etches his accusations in gold plates.

It’s conceivable that Comey has been acting at Obama’s behest via a Presidential Policy Directive (PPD) that would have be signed while Barry was president. Such a PPD could conceivably authorize Comey to say certain things that might be contrary to fact as well as do certain cover-ups in perpetuity. It may have left certain things in Comey’s sole, irrevocable discretion.

The legality of a perpetual directive might not be complete, but it might fly just the same unless Trump would cancel such a Obama’s PPD. (Trump probably wouldn’t see it appropriate to cancel all of Barry’s PPD’s as if he were draining the swamp, as it might release people from NDA’s and the like.)

This just confirms ,by the FBI, that Comey’s leak ofthe memo was against FBI policies and probably illegal.

Now that he is under investigation Trump should subpoena the memos and laptop used to create them. There may be an evidence problem such as chain of custody, validation and wiping of the laptop. Now that’s obstruction.
