When Comey named Fitzgerald to looking into "who leaked 'Plame works at the CIA'" he eventually expanded Fizgerald's power to be commensurate with the AG, and beyond the limits of jurisdiction defined in DOJ rules at 28 CFR 600. I'd have to look up the initial grant, but leaking of NOC cover is a crime, and that was the gist of the allegation.

Rosentein's grant to Mueller is the third time in history this regulation has been invoked. It specifies no criminal offense.
