The problem with these special counsels is that they always want to get a scalp, and they never stop until they do. Ken Starr was appointed to investigate the Clintons’ shady dealings with Whitewate, and yet Starr got Clinton on a process charge for lying about a completely unrelated event, having sex with an intern, that was far outside his original mandate.
Patrick Fitzgerald was appointed to find the leaker of Valerie Plame’s CIA employment. It turned out to be Richard Armitage, a Democrat. So instead he got Libby Scooter, a Republican, on a process charge for misremembering certain dates during a routine FBI interview - an interview that was not recorded, had no contemporaneous notes taken, and where the FBI agent when cross examined and was revealed to be just as confused as Libby was. And yet a DC jury convicted him anyway in what many legal experts thought was a travesty of justice.
It has never been shown that Nixon knew about the Watergate break-in in advance. (Historians agree he didn’t.) So Leon Jaworski got Nixon on a process charge for trying to protect Gordon Liddy.
