well, I would guess, after today’s testimony, that the proper thing to have done, and to do now, is to enforce the order.
Congress and the Executive branches are equal and each may cancel the other out. Both make law. But the judiciary’s power is limited to deciding cases. To decide a case, due process applies. That all of the countries named were also singled out by Obama, and entry to the USA from those countries was made more difficult under the previous admin, which was also under Yates watch, who raised no issue, and that there was no law from Congress contrary to Trump’s order, Yates’ refusal to continue to restrict travel, in essence, lifting the Obama restrictions in the process, seems like a summary judgement was made without benefit of due process or Congressional authority. But what do I know?

While in the Navy, I challenged the orders of my superiors many times. Each and every time, whether the boss was an O-2 or an O-7, that challenge occurred behind closed doors.
