GOP Senator to Sally Yates: What Gave You the Right to Declare Trump's Travel Ban Unconstitutional?
Townhall.com ^ | May 8, 2017 | Cortney O'Brien

Former Acting Attorney General Sally Yates infamously refused to enforce President Trump's executive order on immigration, which banned immigrants from seven Middle Eastern and African nations. Because of her refusal to comply with the order, Trump relieved her of her duties.

At a Senate Judiciary subcommittee hearing Monday, Yates stood by her actions, insisting she believes the travel ban is intended to discriminate against Muslims. She could not in "good conscience" defend it and or send DOJ lawyers in to defend it.

"I was not convinced it was constitutional," she told Sen. John Kennedy (R-LA). "There was no way in the world I could send folks in there to argue something we didn't believe to be the truth."

That's when Kennedy challenged her assumptions.

"Who appointed you to the United States Supreme Court?" he asked her. "At what point does a statue or an executive order become unconstitutional?"

Yates said she believes it is the responsibility of the attorney general to make those conclusions. As for the travel order, that was not a decision she "took lightly."

To the moral Relativist, no culture is better or worse (except ours) than another. Relativism rationalizes public services for illegals, regards slave nations as equal to free republics, and the admittance of murderous muzzies.

The Relativist denies the existence of the Laws of Nature and Nature’s God, and with it, our Declaration of Independence.

These people dominate K-16, and sleep with clear consciences.

The Supreme Court does NOT have a Constitutional mandate to definitively determine Constitutionality of an act of one of the other branches. That characteristic was assumed by Chief Justice Marshal and not universally accepted at the time but by continuing to claim the ultimate power in the American system. the Court eventually got its way.

Madison was very concerned that there was no check on the Supreme Court.

We can see that in Roe vs Wade.

It isn't that they are determined to get themselves killed which is so bad, but their determination that *we* are to be killed right along side them without a murmur of protest which takes them from bad, to downright evil...

I’ve always thought that liberals would have already lost America if the right wasn’t here to protect them from all their horrible ideas.

Making decisions outside of one’s assigned job description. It’s like a car mechanic telling the locals what cars they are allowed to purchase. Sit down. Shut up and do your assigned job or you’re fired.

Here's the problem with Yates PERSONAL decision. In other courts, the order IS being defended and it WILL be defended in the Supreme Court.

She played a "Power" card and lost. She doesn't care...she just wants to make the history books.

From the link. This must have been written by a bucket full of liberals with nothing more to do but write this page. This is just a small sample.

This power of "judicial review" has given the Court a crucial responsibility in assuring individual rights, as well as in maintaining a "living Constitution" whose broad provisions are continually applied to complicated new situations.

We call it cutting your nose off to spite your own face.

They defend Islam in order to offend christianity, the religion that created this nation and it’s freedom, that Islam will destroy.

Sally Yates has put her chips in on the side of the Islamic horde being sent to kill our children.

Jay Sekulow was discussing this yesterday.. Can’t wait to hear his commentary on that excerpt. In fact, the ACLJ could have some legal challenges. A one woman judicial review? Sounds like a witch burner.

Sally Yates - self declared enemy of civilization. She needs a meeting with some of the Islamist warriors she has facilitated into the US.

What gave her the right is that she has balls unlike the pussy Senators asking questions.

GOP is a freaking laughing stock compared to the weakest libs.

The left has, however misguided, the courage of their convictions. Republicans act on nothing but to fund and support the left. A pox on these high-minded transgendered, GOP drama queens.

I totally agree.

I posted it in response to arthurus as it appears that is what he "lifted" for his dissertation.

There is an old book about the notes during the debates on the Constitution. It is the best "brief" I have ever read.

I think the title is "54 men and the Constitution"...based on the notes of Madison (I think that's pretty close to the title)

I'll look it up.

55 Men, Story of the Constitution by Fred Rodell.

It addresses as a problem...the Supreme Court has no check.

This also addresses what would happen if there were more poor people and the power they could wield. We saw that with the election of Obama.

The book is inexpensive. Well worth the read.

This is what we should use as a teaching tool in our schools.

“She played a “Power” card and lost. She doesn’t care...she just wants to make the history books.”

This, Hillary and her personal servers and Planned Parenthood activities are all examples of “Girl Power” gone wrong.

She had two, and only two, options:

1. Support the Order

2. Resign
