Specific States would not have to face far left San Francisco partisans when the inevitable lawfare suits hit them.

For example, the State of Arizona would not have faced them in the appeal of SB1070. A new federal circuit means a new beginning with judges who more represent the legal sentiment of the States they are from.

With just a bit of attention to the character of the judges appointed these things stand a FAR greater chance of NOT happening.

Just one of many arguments to constrain the Ninth.
