California bill to eliminate bail system clears first hurdle

A bill to do away with California’s bail system — which reform advocates say punishes the poor for being poor — cleared its first legislative hurdle Tuesday, inching the state closer to sweeping criminal-justice reform being proposed across the country.

Passed 5-1 by the Senate Public Safety Committee, the law could lead counties to release many of the 46,000 Californians behind bars, awaiting trial or sentencing without involving a bail agent. Washington, D.C., and New Jersey have made similar changes — as has Santa Clara County — and California is one of eight states weighing reforms.

“Somebody is arrested, and because they don’t have a few bucks to get out of jail, they’re sitting in jail,” said Sen. Bob Hertzberg, D-Van Nuys, the lead author of Senate Bill 10. “That is not justice. That is not what this country is about.”

Sell it to Mexico. Use the proceeds to build the Wall. Except the Wall will need to be longer. One benefit is that when the Big One hits, it would be on Mexico’s tab.

While I’m at it, how about selling Hawaii to Japan. Hell, they’ve bought quite a bit of it already. And who would want Puerto Rico? Why not have an auction?

Public Safety update Cal.

In the 80s and early 90s we took the prison system from 29,000 inmates (under Brown’s previous regime to almost 200,000, 20 years later. People called for privatization to save money, but the correctional officers union (CCPOA) bribe everyone and got two or three defeated and politicians lined up to support them. Oh, Brown allowed public employee collective bargaining when he signed the bill just before midnight on the last night of his first terms in office. One good thing about the union they support more inmates. However, more inmates more jobs. More jobs more members. More members more dues. Higher salaries raise dues. More dues more salary. More salary more bribe money. Cycle of bribery.

Crime continued and liberals moaned about too many prisoners. But we passed three strikes in a moment of clarity and public self defense. Three strikes lowered the crime stats. Suh-prize, suh-prize.

Then the prisons got too crowed. Not enough beds, Inmates back in gyms triples high bunks. Build some said. Too expensive Davis, Swartzenegger said. Oh, no private prisons run at 66% of costs said the union.

Moonbeam comes back. Hates prisons loves high speed trains and other environmental boondoggles, loves illegals including murderers. Hates dams and bridges and vomits when he sees cement and cars.

Number of prisoners keeps increasing. Let’s reduce sentences. Lie to the public. Public votes for early releases and some exemptions to 3 strikes undermining public safety. Prisons remain crowded. Push more crimes down to the county flood the jails.

Meanwhile, sanctuary cities protect criminals some murderers. See the almost daily threads here.

Sheriffs complain about jail’s bursting at the seams. State and counties don’t build and don’t bring in private prisons. Costs per inmate keep going up. No proposal to build in Mexico and let them run it much cheaper and send the illegals there to do their time. More jobs to Mexicans in Mexico apparently a bad idea. And fewer Cal inmates at the highest price per in the US.

Another proposition, let Brown them release early. Two weeks ago Brown announces another 9,500 early releases. Sheriffs quiet because to will ease the jails somewhat. Brown protected by armed security.

Oh, did i mention, violent crime on the rise.

Still no plan to build not even 1 prison.

What happens in Sacramento? Introduce bill to make the entire state sanctuary to show Trump who’s boss. Public safety be damned. Murder victims families get mocked at city council meetings. State senate president announces his family half illegal.

More crime to come,. Public safety, fughitaboutit. Stay tuned.

Having personally seen someone on the wrong side of the establishment in a small community have their life turned upside down and nearly ruined both mentally and financially for defending themselves when attacked by a person connected to those in power in that community I agree.

Stacked charges, enormous bail, etc and a prosecutor who thought they would pressure into submission, fortunately they underestimated the resources and unwillingness to submit by their victim and it worked out—but it certainly would not have for a person with average means.

Yes, among other things. The entire issue of bail is pretty complex. The idea, of course, is that a one would post a monetary bond to guarantee later court appearances, which you would get back if/when you actually do appear. What it has come to be though is essentially a tax on folks who have to appear before the court. Few folks would be able to post a $50k (as in your example), so they are forced to go to bail bondsmen to raise a fraction of that (typically 10%). This money paid to the bondsman is not refundable, so essentially, in order to be out of jail before trial, in addition to attorney fees and other stuff, you are out $5k right off the bat. The court knows that this is what happens, so why not just accept $5k from the accused, that they can get back if they appear?

Further, the state aim is to get you to show up. For a lot of folks that actually have jobs and lives within a community, the chance of them fleeing is actually fairly small. I think the bond should reflect that. The problem is, if the court routinely exercised such discretion, they would inevitably have hordes of folks claiming they are a bunch of racists, or worse.

Not really sure what the solution is, but there should be some way of handling the stated goal without it being merely a tax upon people accused of a crime.

I wonder how many current California arrest warrants are for those who failed to make their court appearance after being released on their own recognizance?

Had a partner who used to work for Oakland PD. He always said things started going to hell in a handbasket when the courts started using ORs excessively in the ‘60s.

Continue north, wall around lost vegas and continue up the calibfornia NV border. Actually they’d need to continue on the west side of Tahoe since when headed west you get to it from the NV side thus, it belongs to us.

the crime rate went through the roof, and they couldn’t figure the cause.

If only they had more money, they could find a cause maybe not the cuase but a cause that likely would cost money to solve.
