TX Gov Abbott: I Will Sign Legislation That Could Put Sheriffs of Sanctuary Cities in Jail

On Newsmax TV’s “The Steve Malzberg Show,” Gov. Greg Abbott (R-TX) said he will confront the issue of cities that refuse to comply with immigration law by signing legislation that could jail sheriffs of sanctuary cities.

Abbott said, “We have been pushing a piece of legislation in Texas that is going to pass that I will be signing into law that imposes even sterner penalties on counties. It will include things such as further defunding them. It will impose fines. And it could impose jail time for these sheriffs to enforce the laws. Oddly enough these sheriffs could wind up behind the very bars they are releasing these criminals from.”

Sheriffs and mayors, police chiefs, judges, governors and others in positions of authority who actively harbor or give aid and comfort to criminal illegal aliens and fugitives and or otherwise sabotage or interfere with or enter into criminal conspiracies working in concert with others to thwart border security and or immigration law enforcement efforts.

I would break my self imposed Austin travel ban, just to watch that show.

Maybe he can’t, but then again there’s nothing stopping him from pointing out these “elected” sheriffs to ICE/DHS. They CAN arrest the sheriffs.

I don’t go there either and I was born in Austin, much to my shame. But at least the world was reasonably sane in 1984 as opposed to today. From my perspective, at least.

SANCTUARY CITIES ARE A VIOLATION OF EXISTING FEDERAL LAW

The 1996 immigration law ("Illegal Immigration Reform Act of 1996") specifically requires local officials and governments to fully cooperate with the federal government on issues regarding illegal aliens.

A state or local government entity or official may not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual.”

Title VIII, U.S. Code section 1373.

Failure or refusal of local governments and officials to cooperate fully is a violation of the law.

AND - If a local official violates the law and that violation results in a death the official can be prosecuted and receive up to a LIFE SENTENCE in prison.

As in the case of Kate Steinle who was murdered in cold blood by an illagal alien being harbored by the city government in San Francisco.

It is time for the US Attorney General to start bringing charges agains local officials who are violating this law.

BONUS TIME! It was signed into law by Bill Clinton.

Sheriffs are elected. The Governor has no authority to fire them.

In any event, he certainly would have made a stronger point if he had called for legislation authorizing him to jail Chiefs of Police.

Shouldn’t he be arresting Mayors, Chiefs of Police, City Council people instead?

Maybe Texas has different laws, but the ones I’m used to, Sheriff’s Jurisdictions are primarily the unincorporated areas of a county, and it gets kind of tricky when Sheriff’s want to enforce laws in the cities and villages that have their own police forces.

And it is also tricky to arrest a Sheriff, as Constitutionally THEY are the highest law Enforcement official within their own counties. State officials and Federal officials do not have authority over the Sheriff within his county.

Only the voters of the county as a whole have authority over a Duly Elected Sheriff.

Now, if A Sheriff declares his county to be a ‘Sanctuary County, then Yeah, Something needs to be figured out. At the very least, (s)he needs to be removed from office by the County electorate.

But if some dumbass City official declares his city to be a sanctuary for illegals, that is not necessarily a reflection on the County Sheriff.

Yes, my FRiend, but let's not stop at the city level. One is not an attorney, however one suspects that any politician that aids and abets illegal aliens (who in turn, commit more crimes) should be equally culpable for those crimes.

Consider, for example, the governors of states that shield illegals at the state level. Could they not be considered complicit in a court of law for any further crimes committed by said illegal aliens?
