Trump could 'do an Andrew Jackson' to save travel ban

The Trump administration Friday afternoon filed for an appeal of a Maryland federal judge’s ruling that the revised ban violates the First Amendment by disfavoring a particular religion. The case goes to the U.S. Court of Appeals for the 4th Circuit in Richmond, Virginia.

But a federal judge in Boston approved the original order, noted attorney Robert Barnes in an interview with XM Sirius radio’s Breitbart Daily News

Barnes, arguing the Constitution and federal law give the president the authority to restrict entry to the country, said Trump could “always do a true Andrew Jackson,” the last president to challenge a court “usurping authority they did not have.”

Jackson’s response to the Supreme Court, in that instance, was: “Well, they’ve issued their decision; now, they can enforce it.”

The court trying to apply the religion clauses to an immigration or national defense issue....is totally wrong on the law, as any second year LS student knows. And, this simple fact is available for the judge to look up ... in the constitution, in precedent cases, and in statutory law...as well as several excellent Constitutional Law commentaries of high esteem, respect.

Based on the above, it does not seem possible that
ANY judge could be this stupid.
therefore, he must be on the take or otherwise controlled or sold out to the enemy?????? or?????

I’m deeply disappointd with Trump on this issue. He’s letting lower court judges run all over him when it is well within his authority to ignore their rulings and enforce his ban until the Supreme Court makes a ruling.

“?????? or?????”

Like all good liberal moonbeams living in their plastic self-made reality, the law does not apply to them and is only what they say it is at any given time - scraps of paper written by old dead white slave holders are disgusting and to be disregarded.

See? Perfect sense.

The problem with the Andrew Jackson approach is that Trump would have to get several agencies to ignore a court ruling and act on his orders. They’re not likely to do that. Jackson simply refused to lift a finger in response to a court order. That was a whole lot easier to pull off since he didn’t have to make anyone do anything.

Trump needs to take this to the voters, and then to ask Congress to restrict the appellate jurisdiction of the federal courts, to redraw judicial boundaries, and to appoint conservative jurists.

Trump needs to take this to the voters. . .

Good point you raise. And on second thought, I'm thinking that's what he's doing: Letting these fiction-writing judges make themselves and their seat-of-their-pants legal logic into targets. Probing the wound with the angry voters will give him the momentum to make big moves to right the ship as you suggest. As well as getting his way 100 percent on immigration.

Someone has to cut-off the money.

Load Soros into a plane and send him to a country that has an outstanding warrant.

Then tackle the loony judges. Impeach them and get rid of the life-time employment guarantees.

He and his Solicitor General must first make a formal appeal to the respective appellate divisions and requst a stay pending outcome of the appeal. Then, if they lose, the same appeal must be made to SCOTUS. he idea of doing a Jackson is fantasy. Jackson had the unwavering support of the Congress. Today the reaction would drive the media nuts and their demands for impeachment would be overwhelming for enough of the Congress to make impeachment likely and conviction probable.

DJT should do this and just say
"Hey judge - you don't have access to the classified briefings that I do. MY FIRST PRIORITY TO THE AMERICAN PEOPLE THAT ELECTED ME IS PROTECTION OF THE HOMELAND, and certainly NOT to foreigners who want to come here. END OF STORY - MY EO STANSD AS WRITTEN". No questions from the press will be taken.

Yours is the only adult response on this thread. The appellate process to include SCOTUS is Pres. Trump’s only recourse.

Unless....Trump were to continue to issue a blizzard of slightly reworded EOs, forcing the rogue judges to go further on the record as obstructionist jerks.

“The D party needs a thorough house-cleaning to rid it of the SorozNazi/SaudiIsalmoNazi/communist control clique”

Then the D party would number in the hundreds ...

They carried out his first order, so what makes you think they would ignore this order? Not saying your wrong. Just saying they didn’t have any problem doing what his first EO called for.
