Judge Refuses To Throw Out Trump Supporters’ Lawsuit Against San Jose

SAN JOSE (KCBS) – A federal judge is giving Donald Trump supporters the green light to pursue their lawsuit against the city of San Jose. The plaintiffs accuse the city for not protecting them during a campaign rally last year.

The Trump supporters in this case claim that San Jose police officers intentionally steered them into an angry mob of protesters, following a Trump campaign rally last June.

In cases of domestic violence, victims have claimed the the police have a duty to protect them. Unless a specific promise to protect is made, the police can't be held responsible, because the police can't predict if or when someone will violate a protective order.

There are two issues that the court may be looking at here which are outside the protections given to police in domestic violence cases.

Issue one: "The Trump supporters in this case claim that San Jose police officers intentionally steered them into an angry mob of protesters, following a Trump campaign rally last June."

If this is proven to be true, the police will lose. The police knew or should have known that steering the Trump supporters into an angry mob of protesters might result in public violence. Generally, the police do their best to make sure differing sides are separated.

Issue two: “We’ve seen video appearing on international local and national media that shows the police standing by as people were getting gruesomely attacked,” said Charles Moran is with the California Log Cabin Republicans."

Going back to the restaining order scenario, if a person is violating a restraining order in the presence of an officer, the officer is expected to intervene. Failure to do so puts the officer and the Department in legal jeopardy.

If officers were present and it is proved that they saw, and did nothing while people were being attacked, again, they put themselves in legal jeopardy. An unlawful violent act committed in the presence of an officer requires an attempt to stop the violence, and arrest the person committing the violence.

Note: I cannot predict either, if the trail will go forward, or what the possible outcome will be.

Yeah, but Al Sharpton got some significant change from NYC because a civilian stabbed him during one of his "marches".

Different standard, I believe. They are claiming the police “steered” them into being attacked by this group. They are claiming the police were actively engaged in helping them get attacked.

in Castle Rock v. Gonzales and other cases the courts have ruled that the police have no obligation to protect.

It is an additional crime to suggest that, that entitles the cops to help the criminal rioters. The cops in San Jose, under orders from their Mexican chief, didn't just stand by...

Yep, the police were massed to block one street adjacent to the convention center, forcing attendees to walk a long way around a large block, then funneling the people back along the front of convention center ... where the mobs were waiting in groups along the sidewalks and entrance to underground parking lot. Other police stood idly by on opposite side of street, just observing violence.

They should have cleared the primary sidewalks of rioters so people could leave without being attacked. And cleared all other mobs hanging around the area. Very bad scene, that Major Liccardo blamed on Trump and his supporters.

First thing I would do is subpoena the Chief of polices Twitter, email private and public I bet they will find collusion with the Protestors. If you look back at the video all of them were acting with confidence right in front of the cops. I would bet since many were paid agitators paid by Hillary they were given a heads up that they could beat on people and not fear arrest.

Yeah, there’s going to be some interesting depositions. If the officers say that there was a “stand down” order, brass is in the spotlight. If the officers say there was no stand down order, they will then be asked why they didn’t protect the people. Tough situation!
