They are shared property with the understanding both parties have to agree to their use.

You are trying to defend a man who posted private materials on the internet years after a relationship ended.
There is no defense for that.
You can bob and weave all you like, a man with any morals at all would not do something like that.
He for damn sure wouldn’t blame her for it.
He for damn sure wouldn’t trash her for her behavior, when she had simply done something to make him happy in the day.
Hate to say this, but your defense of this guy certainly lives up to my opinion of many practitioners of the legal profession.
