You are just plain wrong. The relevant statute is 28 U.S.C. section 532. The AG can simply fire Comey, and I’m fairly sure Sessions would do just that if Trump asked him to.

Okay, let’s tell the Obama people what to shred. that should finish the case. This is why evidence for a court proceeding is not publicly made available to anyone prior to trial except for investigators and attorneys. Disclosure could create a mistrial through the media and has many times before.

If Trump provided no evidence to keep it from being destroyed or hidden, how would Comey know there wasn’t any and try to get the FBI to “PUBLICALLY” reject the allegations? Intelligence, or the law, obviously doesn’t appear to be within his grasp. This is the same guy that rejected Hilary’s illegal actions because he said she didn’t do them on purpose. How would he know? Moron!!!!!!

You think that Trump can just go in and fire whomever he wants. Congress can impeach him. Trump cannot fire him.

As much as you like to think John Wayne runs things, he doesn’t. And he never did. So go back to the trailer and keep an eye on your wife, the mailman is in the park.

The FBI is a subset of the DOJ, which is an executive department, and they do answer to the President, who can certainly dismiss its chief; as several other posters have pointed out, this is not without precedent. It is not like the Supreme Court, which is a separate branch of government to the executive (the judicial branch).

According to a 2014 report by the Congressional Research Service, “there are no statutory conditions on the President’s authority to remove the FBI Director.” In other words, the President can indeed fire the FBI director. An FBI director can also be removed by congress, through the impeachment process.

Because firing an FBI director is certain to bring accusations of playing politics with law enforcement against any president who chooses to do so, Clinton repeatedly asked William Sessions to resign his post. But Sessions refused to step down.

So in July of 1993, saying that he had been advised by then-attorney general Janet Reno that Sessions “can no longer effectively lead the bureau and law enforcement community,” Clinton fired the FBI director — eventually appointing Freeh in his place.

You were treated disrespectfully but you are still incorrect. The director of the FBI is not an impeachable position. The Director serves a ten year term but the FBI Director can be fired by the president.
In 1992 Bill Clinton fired William Sessions as FBI Director after Sessions refused to resign.
“Nearly six years through his 10-year term, Sessions becomes the first director in the 70-year history of the bureau to be fired. Calling a news conference moments after he got the word, Sessions maintained his defiant and proud posture to the end, saying he had led the bureau to “astounding accomplishments” and had refused to submit to pressures to resign because he wanted to preserve the “independence” of the FBI.”

FBI Directors

“They must be confirmed by the United States Senate and serve a term of office of five years, with a maximum of ten years, if reappointed, unless they resign or are fired by the President before their term ends. The current FBI Director is James B. Comey, who was appointed in 2013 by Barack Obama.”

My bet would be that Trump doesn’t want another “Senate Confirmation Witch Hunt” at the moment, but will get around to Comey in due time. I will also bet that he already has developed a list of replacements.
