Sen. Lindsey Graham (R-SC) is proposing a federal law that would require all candidates for president to release their 1040 personal income tax returns, including President Donald Trump. But such a law should not survive a court challenge, because it would be unconstitutional.
Article II of the Constitution sets forth three criteria to be eligible for president. A person must be (1) a natural born citizen, (2) at least 35 years of age, and (3) been residing in the United States for at least 14 years before the election.
That is all. Everything else is left to the voters to decide whom they want as commander in chief. Consequently, a federal statute requiring submitting tax returns would impose a requirement beyond what the Constitution specifies. Any candidate running for the presidency in 2020 would have legal standing to challenge the statute’s legality in court.

While what you say is true Ken, the Constitution does allow for amendments as well. Thus if they offered it up as a amendment and that amendment was passed and ratified then it becomes constitutional.
Adding requirements beyond what is in the Constitution is something which happens continuously. It’s why we have tens of thousands of pages of laws and regulations.
It is contradicting the Constitution that is un-constitutional.
That said, it’s a bad idea, and Graham is a grandstanding fool.

This tax return thing is the biggest BS canard ever. I don’t give a crap what’s in any candidate’s tax return. Are they under arrest? Have they been charged with tax fraud? If not, who cares what’s in the return?
There is no enforcement mechanism at all to ensure a candidate is a natural born citizen.
It depended on the good will and honesty of everyone.

That means one who is naturally an American because they couldn’t be anything else, born here of citizen parents.
Everyone in DC wanted that changed without the hassle of amending the Constitution.
The Senate passed a resolution declaring McCain a natural born citizen because he had TWO citizen parents, even though he was born in Panama.
Then Obama runs and wins based on just being born here, even though he told us on his website he was born a British subject as the result of having a foreign national father.
So the standard went from born here of citizen parents to just TWO citizen parents to just being born here in one election cycle without amending the Constitution.
According to this standard the recently deceased King of Thailand was eligible, he was born in Cambridge MA, as well as every anchor baby with no loyalty to the USA.
This was done intentionally because Rubio (no citizen parents), Cruz (foreign birth, one citizen parent), Jindal (no citizen parents), George P Bush (one citizen parent) and Haley (no citizen parents) were all ineligible and the future of the GOP.
