Federal Appeals Court Upholds Maryland Assault Rifle Ban

A federal appeals court upheld Maryland's ban on assault rifles, concluding that the powerful military-style guns outlawed by the measure are not entitled to protection under the Second Amendment.

The 10-4 ruling, issued by the entire Fourth Circuit Court of Appeals in Richmond, reverses a decision by a smaller panel of judges from the court last year that called the law's constitutionality into question.

The bill was steered through the Maryland Senate in 2013 by then-Sen. Brian E. Frosh in the wake of the deadly shooting at Sandy Hook Elementary School in Connecticut. Since elected as the state's attorney general, he has defended the law in court.

Frosh, a Democrat, called the dual role gratifying and said he was very happy with the ruling.

They’re right. The 2nd amendment did have the “assault weapon” clause.

Technically the 2nd Amendment was intended only to protect military style weapons - for the Militia (which is everyone...).
This should make it to the SCOTUS and be overthrown with Justice Gorsuch’s help.
Just think what would happen, though, if we had a Hillary! appointee, instead...

Wikipedia's synopsis of that law: "Certain models of firearms are banned as assault pistols and assault long guns. It is illegal to possess an assault weapon or a copycat weapon with two or more specified features (folding stock, grenade/flare launcher, flash suppressor) unless owned before 10/1/2013, or received through inheritance from a lawful possessor and not otherwise forbidden to possess.[1]"

The bill itself is sixty-two pages in length. You can't drive through the state with anything on the banned list and if you still happen to have a weapon that's legal in the state, you better hope you can defend yourself with 9 rounds or fewer.

Individuals were allowed to own artillery at the time of the revolution.

No exception was made for “military type” weapons in the amendment.

Pray tell, precisely which weapons in the eye of Maryland's judiciary are not "assault" weapons? And who gets to define what is, and is not, "assault"?

Exactly right! The weaponry of the day (when the amendment was drafted) as used by militia was no different than that employed by patriots and there was no distinction between the two. If the government can’t disarm us, it wants us to be “outgunned.” They only refer to the framers’ intent when it suits their “perverted” senses.
