Yes, including when the boss lies to the unemployment dept about it. Been there, done that.

I was laid off, he said “We don’t need you any more”, the day I told a machine shop owner in Texas I couldn’t work overtime because my registration was expired and I had to be at their office to renew it, and in fact was planning to ask to get off an hour early to do it. He came out a few minutes later and told me they didn’t need me any more.

I contested it, got a phone hearing with me, former boss and unemployment office. He lied, told them on the phone I was fired for not doing my job. I asked them ok, if I was not doing my job, why did he ask me to work overtime a few minutes earlier?

No good, unemployment office believed the boss, of course, and denied unemployment. He lied, got away with it, screwed me in the process. Another one did similar.

The unemployment office people tend to lean toward the boss every time, unless you have some pretty convincing evidence he was in the wrong. At least here in east Texas...if the boss says you weren’t doing your job, they don’t go talk to other employees, or anything else, they just take his word for it, even if he’s lying, even if he asked you to work over time just before your “firing”.

Not necessarily. My husband owns a micro-small business. We had an employee file for unemployment after abandoning the job and working a total of five hours. They gave it to him and jacked up our rates for three years before we could get them to listen to us. New Mexico is corrupt that way.
