“Fitzpatrick reportedly questioned the state employee if she was “supposed to” register. The DMV agent responded, “it’s up to you.” The woman would later sign a document attesting to U.S. citizenship, allowing her to become a fully registered voter, reportedly casting ballots for federal candidates in 2006.”

The state employee who allowed this should be the next one hauled into court and the news that government employees allowing this to happen will be prosecuted should be spread far and wide.

Disagree. The employee wasn’t in a position (nor should be) to offer advice any way or form. THAT is where the liability would come. Had the employee indicated one way or the other the illegal alien could have said “I was told it was OK.”

That attempt failed since the State employee wisely (and probably under directives) gave a proper ambiguous answer: “it’s up to you.”

I think it was EXACTLY the correct response and the court clearly agreed with me.
