FBI admits no arrest warrant signed when Duane Ehmer was arrested, contrary to agent's testimony

FBI agents admit in court papers that they had no arrest warrant when they took Duane Ehmer into custody at a checkpoint outside the Malheur National Wildlife Refuge on Jan. 27, 2016, contrary to an agent's testimony earlier this week.

It wasn't until the day after Ehmer's arrest that a federal magistrate judge signed a criminal complaint against Ehmer based on an FBI agent's probable cause affidavit.

Ehmer's lawyer Michele Kohler has urged the judge to suppress evidence found in what she contends was an unlawful search of Ehmer's car and horse trailer after his arrest without a warrant.

FBI Special Agent Todd Scott, who is assigned to the agency's Denver division, had testified by phone earlier this week that he arrested Ehmer on a federal arrest warrant last winter.

In a written memo filed in court Thursday, Scott said he didn't realize the warrant hadn't been issued until the day after Ehmer's arrest until a prosecutor informed him after court this week.

"Prior to arresting Mr. Ehmer, I received information from the FBI Command Post that an active federal arrest warrant existed for Mr. Ehmer,'' Scott wrote. " I did not question the validity of the information provided nor did I review a copy of the arrest warrant, as is my normal practice. Due to the remoteness of my location I did not have the ability to review the alleged arrest warrant.''

Assistant U.S. Attorney Craig Gabriel argues that Scott testified and acted in good faith.

Ehmer's lawyer has until the end of the week to file a response. U.S. District Judge Anna J. Brown is expected to issue a ruling before jury selection starts next Tuesday in the trial for Ehmer and three other occupiers.

Keystone cops want to be treated like they are acting in good faith?

What about the extra shell casings the FBI were picking up because they didnt fire any rounds at Lavoy like the 2 OSP goons that shot him in the back twice?

Not having a warrant in hand is not uncommon when making an arrest.

When it turns out that no warrant exists, that is a problem. A huge problem that the government needs to fess up and make right immediately. As a result they should lose all the evidence collected from the individual and his vehicle. Fruit of the poisonous tree.

Uh...”yes, I had a warrant” and “well, I thought I did but there was no way to check” are not exactly the same thing, are they? “I didn’t have a warrant in hand, hadn’t seen one, and couldn’t check” was the truth, but it wasn’t the testimony. I’m trying to figure out how “good faith” works into this and I’m coming up blank.

Atlanta Olympics, 1996:

An overweight security guard Richard Jewell finds a bomb in a crowded Atlanta park, an act of terror. He alerts the cops, but the bomb goes off and a desperate Bill Clinton facing a reelection bid ORDERS the FBI to simplify things by making Richard Jewell the perp.

Knowing Richard Jewell revers “real cops” the FBI brings him in for questioning, finally pretending to relent and accept his story of innocence. They then flattered him and lowered his guard by chatting him up in grand style like A Law Enforcement Colleague.

The FBI then claimed to Jewell that they were making a Training Videotape simulation in which a perp under questioning breaks down and confresses to a bombing, “Ah shucks, our actor crapped out, got sick, say Richard, would ya help us FBI guys out..?”

A micrometer away from consenting to help them with their “training video”, Jewell suddenly realizes if he cooperated with “his friends”, they might turn around use the tape against him in the world famous bombing that just transpired.

He calls his ex-roomate, a lawyer, who admonishes Jewell that he’s in very grave danger. He leaves the FBI questioning and AVOIDS LIFE IN PRISON BY A WHISKER.

YOUR FBI IS **FINE** ACTING AS AN INSTRUMENT OF POLITICAL TERROR.

It started at least 20 years ago.

A victory in the original 1993 ATF assault on the Davidian compound was viewed by the ATF as a foregone conclusion --they brought a TV video crew along to record their bravado and their "go" code was "Showtime":

Later in the FBI assault on the compound, 80 people and 22 kids died in the spectacular fire, with ambulances and fire crews kept away.

While filming, they then raised the flag of the ATF on the still-smoking embers.

No one from the FBI faced any punishment.
