I just heard that too; supposedly one of the other judges in the 9th Circuit has asked that the circuit consider if there should be an en banc rehearing of the 3 judge panel decision and has asked both sides to submit briefs on this issue.

Why would the 9th Circus ask for that?

Don't know, but maybe to give the 9th another bite at the apple to strengthen their decision. I can't believe it would be for any reason to help the Administration or further justice.

Because Trump called the bluff.

The panel essentially took over the country and gave everybody on the planet rights under our constitution.

The expected result was that Trump would appeal, the Supremes overturn the 9th but slap Trump’s wrist. If Gorsuch was on the court at the time of the reversal, Dems scream bloody murder and demand a more “moderate” judge when the next Supreme quits or croaks.

Trump said, “OK, dummies, I won’t appeal, good luck with that” and they now need a way to back out.

Trump will make them say that they were wrong, in a very public manner. It will make it much, much harder for judicial activists to oppose Trump in the future.

Trump has great big brass ones, that’s for sure.
