Actually CRUZ could argue the case, there is precedent for a member of Congress to do so. In the Amistad case of 1840, John Quincy Adams, former President and at the time a sitting member of the House of Representatives argued before SCOTUS. So did Abraham Lincoln when he was a Congressman.
