Don’t be fooled. McCain & Flake actually want to protect/preserve the 9th Circuit Court as it exists now. Their proposal will never go anywhere in the Senate & certainly would not get 60 votes for closure - and they know it.
The 9th Circuit Court needs to be organizationally obliterated but through legislation originating in the House of Representatives under “reconciliation” not subject to the 60 vote closure requirement.
If you split up the 9th circuit....why not have Arizona, Nevada, Idaho, Montana and Alaska within the new Circuit....basing it out of Tucson? Force McCain and Flake into the corner of not having the court establishment in their own state?
