My working theory - and it’s resolving clearer by the hour now - is that David Brock set Robart up to this in his quest to burn down the DNC in order to re-make it in his image.

If the 9th sides with Trump, it’ll pretty much validate that theory, in that the non-nihilist RATS don’t want to burn it all down, just yet. Even Pelosi is suddenly defending DJT.

I think the Democrat leadership is learning the lesson of keeping one's powder dry. Unfortunately, Republicans never learned the lesson of finally using it.

Trump needs to force the otherwise useless McConnell to order the senate into “Recess.” During the recess, appoint all remaining cabinet nominees.

So the crybaby Democrats have jettisoned the tradition that a President should have the cabinet team he desires and have forever more guaranteed that the simple “advise and consent” approval process will be yet another hyperpartisan donnybrook that endangers our nation any time a new President takes office.

The courts are the left's soldiers of the moment.

That's because it's the only branch of government left remaining for them. But the great thing is, the judiciary is by far the weakest section. In fact, it's not even close to being in the same league as Congress (and to a lesser extent, the executive).

But the best part is that the judiciary below the SC owes its actual existence to Congress. In addition, the same Congress controls & defines what issues they can and cannot inject themselves. Lastly, the very power they wield today is merely asserted (Marbury), and has only been honored through tradition and practice since that time.

I actually believe Trump set this EO up in order to force a confrontation. The issue is not only one of nat'l security, even though that's an obvious plus. No, the real play is that his EO merely directs the rightful & lawful execution of a law Congress itself PASSED.

There's no way the judiciary can win this battle. The true test will come if the 9th passes and it heads to the SC. If the SC splits 4-4, then Trump merely openly defies the court order. Now the issue passes to Congress to consider impeachment. Can you imagine the constitutional crisis that would emerge if Congress deferred their very own power to a create of their own making?

In fact, they would be in direct violation of their oaths to uphold the Constitution itself. At that point, the military might consider getting involved, because now were dealing with the potential of domestic enemies. And thus, civil wars are launched.

Now, do you think for a moment that all the players - who are well schooled, very bright, and understand everything perfectly well that I outlined above - don't fully comprehend what's at stake and the potential ramifications?

That's why the courts are going to lose, while Congress and the executive are going to win. Like a chess game, once the end moves are fully recognized, good players resign rather than play through to mate. So too will either the 9th or SC rule in favor of Trump before they lose on an even bigger scale.

You have a well reasoned argument, but I think you need to factor in that Trump is really a populist third party President who was and is opposed by much of the traditional GOP leadership. If the 9th Circuit rules against him, the SC deadlocks and Trump then defies the court, I think the old guard GOP and the Rats will unite and try to impeach and remove him. At that point, your comments about the military would come into play.

I came to realize early last year that everything Trump does is planned out in advance. During the election cycle, each of his so-called "controversial statements" was well researched beforehand so that he knew exactly what the actual facts of the matter were.

With respect to Robart and this particular EO, I think it's pretty obvious his team thought out each of the particular possible outcomes. In fact, since there are only 8 combinations, it's pretty easy to game play. (3 levels - bench, appellate & SC, each with either yes/no decisions.)

Now, the key to any game of chicken (or negotiation) is to not only determine what strengths the other party has, but what weaknesses they have with respect to your own strengths & weaknesses. When it comes to constitutional priority, even the most rabid, dogmatic leftist will concede that Congress is the big dog. In some sense, the only dog, as the executive is actually subsidiary.

So, let's take Trump: he knows the only tool the left has is the judiciary. He also knows it's a paper tiger - "there's no there, there". What he needs is to force the issue so as to diminish the court's power & influence over his entire MAGA agenda. Now, which issue is basically sacrosanct, and even better, an actual law Congress itself created?

Well, let's put the ball in play. It doesn't matter if a so-called judge like Robart issued an injunction. If another judge had denied the initial motion, then an appellate might have reversed and so on up the chain to the SC.

The key to this entire exercise is to reduce the power of the courts. It's like the Navy & Air Force bombarding and bombing Normandy before the D-Day invasion. Once key defensive targets were destroyed, then the Allies could proceed. Likewise, once the judiciary is either formally or informally circumscribed, then the MAGA agenda can continue with limited resistance.

Semantic’s argument IS ephemeral, and I hope he’s right, but the Left I know ain’t gonna bend like that unless Sessions has sudden death prosecutions dangling over their heads. And if those prosecutions are deadly enough, they might opt to flee the country.

It would be something if Trump heeled the Judiciary with this one move, but it could only be attributed to massive sticks he wields that we’ll never know, and can only deduce.
