I was involved in a traffic accident last year. The light arrow turned green and I proceeded through the intersection turning left.
A driver coming in the opposite direction blew threw his red light and pulled directly in front of me. I broadsided his car.
I jammed on my brakes and swerved a bit left to minimize impact.
My car was barely damaged, and only at the immediate area of the corner of my vehicle, within ten inches.
His car had a deep impact and a long scrape.
From the impact damage it was crystal clear I told the truth.
He claimed that I sideswiped him.
My insurance company is still going through levels of arbitrators to get his company to cover my damages.
Never underestimate the ability for folks to come up with a reasonable alternative description of reality, even if there isn’t a bit of truth to it.
Dash cameras are required in many European countries and are a good idea in this country just for this reason.
According to reports, the the good samaritan shooter said he felt threatened after the suspect moved quickly as if to arm himself.
So their defense will be that the suspect did not make a threatening move and the shooter did not feel threatened. Now, considering they were in a stolen vehicle, which had just been carjacked earlier, and were in the commission of crime, wheeling out two full carts of unpaid merchandise to their stolen getaway vehicle..
Based on what I am reading, I don’t think the best lawyer around will be able to concoct a reasonable excuse for these guys, nor will they be able to prove the good samaritan shooter did not feel threatened. JMO.
Btw, I prefer to call them traffic collisions. An accident would be a meteor striking your car or a tree falling on it.
99% of traffic collisions are no accident and are generally caused by neglect and or operating a vehicle in an unsafe manner. Oh, and intersections are death traps where green arrows and green lights mean very little. Most intersections would be ankle deep in blood if they never washed it off.
Exactly the same thing happened to me about 15 years ago. My insurance company ended up settling with the other guy’s company for a very small amount because it was more cost-effective to do so. Modern-day highway robbery.
