To: Alas Babylon!

I don’t think many will agree with this but hear me out:

Since the US Judge for Western Washington, Judge James Robart, banned the implementation of the Executive Order to keep certain nation’s citizens from entering the United States, we now find the 9th US Circuit Court has REFUSED to stay his immediate ban, therefore I think the Trump administration should wait before proceeding.

I think the Constitution is CLEAR that the EO was valid and Constitutional, and therefore, cannot be ruled against strictly on a partisan basis. NO Federal Judges decisions should ever be made over politics—the fact the Left so desires this is one of the main things that are wrong with this country.

There will still be a full hearing at the 9th Circus, but there’s no guarantee they will do the right thing. In fact, they’re probably going to double down.

If that happens, and Trump appeals, it goes to the Supremes, who are currently divided 4-4, and I’m sorry, but we CANNOT rely on Anthony Kennedy or even John Roberts.

If Trump tries to get this fixed FAST, he will wind up with it being decided by the 4-4 SCOTUS. If the decision is tied, the previous court ruling—the 9th Circus—applies.

That would be devastating!

So, we now have a nominee—who is a great, Constitutional Jurist—in Neil Gorsuch. MOREOVER, he used to clerk for Anthony Kennedy, and in my opinion, will ensure Kennedy does the right thing, Constitution-wise.

How long will his nomination fight last? I do believe he will ultimately be seated, but it will take some time.

Therefore, if the full 9th Circus rules in favor of partisan politics and feelings, rather than the Constitution, as they should, but so often do not, we need to wait for Gorsuch to be seated in order to ensure the Constitution prevails.

In the mean time, we need to press the President and Congress to reel in Judicial Activism. Serious, and bigly. Maybe even an Amendment proposing term limits (who in 1787 thought the average life span of an American would be 80 years plus?) and other things.

The current crisis, which the Left has created and where their Judges have ignored the Constitution as written, just might give impetuous to the nation to once and for all fix this mess called Judicial Activism.

It surely would. This is a clever trap which has been laid for him. A bad decision here has the possibility of ruining his entire policy on illegal immigration as well as stopping Muslim Jihadism.

Can you say "Constitutional crisis", followed by extreme left-wing violence and governmental sabotage?

So they moved up his announcement this week from Thursday to Tuesday. Have they announced yet who will shepherd him to his meet and greets with the Senators? Begun the process? I’d say they’d best get moving on it—and then go with the 51 to approve, should the Dems try to slow the process at all.

Your fears have been mine, too, AB.....but this is judicial overreach in spades. Not even a politicized Supreme Court would split on this one. In essence, it awards US lawmaking to any circuit court judge and applies it to the entire country. It would create a constitutional crisis.

Worst case, re-raise the issue and send to the Supremes again in April.

I would like to see Trump issue another EO: A “be careful what you wish for” or “you want ‘em, you got ‘em” EO. All future “refugees” go to Seattle.
