Law would cut off aid to countries that refuse to accept illegal immigrant criminals

A proposed law that would punish countries that refuse to take back their illegal immigrant criminals is two years too late to save Casey Chadwick, but the Texas congressman behind it figures it’s the least Washington can do.

Chadwick was murdered in 2015 by Jean Jacques, an illegal immigrant from Haiti and one of thousands freed onto U.S. streets each year after they serve prison time because their homelands refuse deportation. But a proposal by Rep. Brian Babin, R-Texas, the Criminal Alien Deportation Enforcement Act, would force such countries to take back their citizens or risk losing foreign aid and travel visa privileges.

What they want should not be an issue.

Fly them to their country of origin in a military cargo plane, dump the cargo and fly home.

All illegals (regardless of country) in our jails and prisons should be contracted out to the country of origin. Would be a heckuva lot cheaper and effective.

China is hugely dependent on us for exports. Their economy rides on the fact that we account for the number one position in consumer spending. Without us, China is dead!

We already have a law that says that countries that refuse to take back their criminal aliens will have visas to the US cut off. This is a far more powerful tool that Obama refused to enforce.

I think this law has been ignored by more than just Obama. One report I found is that just recently it was invoked against Gambia. This report suggested that it was the first time it has been used in 15 years.

Vietnam (along with at least 23 other countries) has been refusing to accept removable criminals forever. It could be stopped overnight if US consulate officers stopping issueing VISAs to Vietnamese.

Interestingly, the law includes the mandatory language "the Secretary of State shall order consular officers in that foreign country to discontinue granting . . . visas." Thus, refusing to enforce it is unlawful.

The law suspending visa privileges for not accepting criminal alien deportees from their own countries is already on the books has been raised by many real conservatives and even Donald Trump. But it has been ignored for years by Obama, Kerry, Hillary, Bush and BJ Clinton. Another law is just another political song and dance.

Here's the law:

INA: ACT 243 - PENALTIES RELATED TO REMOVAL

(d) Discontinuing Granting Visas to Nationals of Country Denying or Delaying Accepting Alien.-On being notified by the Attorney General that the government of a foreign country denies or unreasonably delays accepting an alien who is a citizen, subject, national, or resident of that country after the Attorney General asks whether the government will accept the alien under this section, the Secretary of State shall order consular officers in that foreign country to discontinue granting immigrant visas or nonimmigrant visas, or both, to citizens, subjects, nationals, and residents of that country until the Attorney General notifies the Secretary that the country has accepted the alien. {Emphasis Added}

The Supreme Court decision relating to this issue, does NOT apply this power to discontinue visa issuance. It only applied to the power to detain indefinitely those ordered deported when their country refused to accept them. Before that dangerous criminals were held indefinitely and now they must be release to further prey on the American public.

Well if you do not try you cannot win. But I am sure Trump will demand that the law to deny visas will be enforced. If Rex Tillerson is confirmed he will comply with Trump's demand. Of that I have am certain.

So I see absolutely no problem with the advancement of this law, and those that vote against it, especially the Republicans, will have to answer to their constituents.

Think of all the laws we have that are not enforced. We have immigration laws that are not being enforced. Why would anyone imagine this law will be enforced.

We have laws against murder, but we allow murders to go free to rape and murder the next day.

The point is we already have a law that can address the problem. I am sick of these congressmen who want to introduce more bills that may or may not pass. It is just another example of these bureaucrats trying to steal the spotlight.

Cutting off foreign aid just makes passage that much more difficult. Stop issuing visas and they will accept their nationals back.

Yes, yes and yes.

I am all for immediate deportation into the custody of their native country for ANY illegal immigrant who would otherwise be sent to jail. I don’t mind waiting for their conviction in court here, but then handed over to U.S. marshals for deportation, not into the U.S. prison system.
