I support the waiver, for which I know there is precedent. But just out of curiosity — wouldn’t that be an ex post facto law?

It’s actually a good law. The senior levels of the military are filled with jealousy, backbiting and score settling. The law was intended to minimize the potential for a retired General to come in the next day and fire all his rivals. You need look no further than Civil War and WWII history to explain the rivalries in the senior military service. That said, I support the waiver for Mattis. He is an exceptional candidate who will serve this country and President well.

I think it’s actually the other way around. A liberal NYC radio host suggested that anyone who goes by the nickname “Mad Dog” is all bark and no bite. LOL.

The intent was so that the military was always under civilian control. There are exceptions, like Mattis and Marshal. So I don't think the law is necessarily a bad thing in and of itself.

I’m watching a House committee panel that’s considering the waiver for Gen. Mattis and it doesn’t look good. Am I missing something here?

Yeah, but it goes to the House committee now, and they had previously requested that Mattis appear before the committee for questioning. Mattis agreed to present himself for such questioning. However, the Trump transition team stopped any such presentation, and no the House committee must vote on the “waiver” (which is identical in wording to the senate bill for same) without having the chance to ask Mattis any questions. So, as I type this, the House committee is raising Cain that its inability to question Mattis subverts Congress’s role and renders it irrelevant. Thus, none of the Dims are going to vote for the waiver, and it is likely that enough Repubs will join them to submarine Mattis getting the requisite waiver to serve as Sec’y of Defense.
