Trump is a private citizen until he is inaugurated, he can still sue as well. He's a public figure, so he'd have to prove "intent."

To be more specific, Trump would have to prove "malice."

Fabricating a story that Trump hired prostitutes to piss on a bed where Obama slept sounds kind of like malice.
