In four years, the next who are likely to retire/die are Ginsberg, Kennedy and Breyer. We can go with 7 or 6. Eventually it might be a problem when we are down to Alito, Roberts, Kagan and Sotomayor.

He forgets that the filibuster rule was broken by Reid..... A simple majority vote is all thats needed.Not true for Supreme Court justices. Harry didn't cross that line. It's true for all other appointments, including non Supreme judges.

With GOP in control, the Senate could be sure to go into official recess and allow Trump a recess appointment that might be even less to the Schumer-McCain wing’s liking and let the next election have a voice.

The upcoming electoral map for the Senate doesn’t support this type of action. There are 33 seats up for grabs next election, and only 8 are currently Republican. Many of the Dem seats are in states that Trump won easily. If those Senators obstruct Trump, they are likely to lose those seats. I don’t think Schmuck with be able to drum up the votes for blocking nominees.

We ALL know “Dingy” Harry did not go “nuclear” on the SCOTUS only because there was no vacancy at the time. Had there been one, he would have gone “nuclear” for sure!
Also, If RINO McConnell allows Chucky to delay the VERY REASON many of us voted Trump (SCOTUS), he will show us he’s a liar and part of the problem not the solution... and Trump must Bully Pulpit (aka: Twitter) pounce. For in truth Trump is the 3rd party candidate with few if any “friends” DemWit or RepuBate, in the swamp that is D.C.

I believe that he knows this. He is probably operating under the notion that they can still kick and intimidate the Republicans into doing as the Democrats bid. time will tell whether he is correct in that or not. I am in the wait and see mode myself. I have learned through experience not to expect anything from the Republicans and you won't be disappointed. At this point in time Schumer is sniffing the wind in the direction of the Republicans to see if he can smell the odor of excrement as used to happen when a Republican heard or came near a Democrat.

The Senate (and House) are allowed to make their own rules. A filibuster is allowed under the Constitution.
