Well, the paper I read said that before 1946 Agencies and Departments were only created by or with the cooperation of Congress. After that is when Presidents started creating them by EO.

There ya go. My 1963 TRUMPS your 1953. Problem solved at least until the law can be amended or rescinded altogether, the legal way.

I would also suspect that Trump’s team has already compiled all of the EO’s and is scouring them as we speak so a single EO on his part can rescind an entire notated list of those that need to be eliminated. Add to that the number of independently wealthy members of his Cabinet tells me that these people are strategically placed because they have no need to be collecting a government paycheck. They also know how to eliminate waste.

For obama, this is perhaps a win win. The envirowackos can rejoice and the oil drillers don’t care

Given the great prospects in the lower 48, it is not necessary to go to the excessive expense of Arctic drilling any more.

The problems are two fold.

If we have left Guantanamo, (although the time is short for us to logistically do that) and the Cubans were to march in, no US law is going to get the Cubans to leave.

The pardon of a mass murderer or multiples of them? Totally legal and irreversible. He is already mass pardoning armed drug dealers. Are Mumia Abu-Jamal or OJ next?

If he orders the military to abandon Gitmo with no notice, that might be irreversible. But moving people and their families out of Gitmo without the press finding out might be tough. If the press finds out about it, lawyers could get a court order preventing it by allowing civilian oversight to take control of the base. Cuba only gets it back if every single person has left, so even if all the military personnel follow Ozero’s orders to abandon it the presence of civilians on the base would block repossession.

The decree could be reversed with a simple act of Congress repealing the 1953 statute in its entirety. No need for judges and other questionable officials.
