Michigan Recount Expands, Pennsylvania Sets Federal Hearing

U.S. District Judge Paul Diamond in Philadelphia on Tuesday scheduled a hearing Friday on the request for a recount. The Republican Party and Trump warned that the case threatens Pennsylvania's ability to certify its election before the Dec. 13 federal deadline. Stein's team hasn't produced evidence of hacking, but calls Pennsylvania's election system "a national disgrace."

Also Tuesday, Pennsylvania election officials updated the state's vote count to show that Trump's lead over Clinton had shrunk to about 44,000 out of more than 6 million votes cast. That is still shy of Pennsylvania's 0.5 percent trigger for an automatic statewide recount. A state spokeswoman said 15 provisional ballots remain uncounted

Wikipedia Background Born in Brooklyn, New York, Diamond received a B.A. from Columbia University in 1974 and a J.D. from the University of Pennsylvania Law School in 1977.

Diamond was an assistant district attorney in the Philadelphia District Attorney's Office from 1977-1979. In 1980 he served as a law clerk to Pennsylvania Supreme Court Justice Bruce W. Kauffman, who would later also be appointed as a judge on the Eastern District by President Bill Clinton). Diamond returned to the District Attorney's Office from 1981 to 1983. He worked in private practice in Philadelphia from 1983 to 2004, when he was appointed by President George W. Bush to the Eastern District. Diamond also has worked as an adjunct professor of law at Temple University Beasley School of Law from 1990 to 1992.[1]

From 1993 until 1995, Diamond worked as the treasurer and as the counsel for the failed 1996 presidential campaign of U.S. Sen. Arlen Specter.[2]

On January 20, 2004, President George W. Bush nominated Diamond to a seat on the United States District Court for the Eastern District of Pennsylvania vacated by Herbert J. Hutton. Diamond was confirmed by the U.S. Senate on June 16, 2004 by a vote of 97-0, and received his commission on June 22, 2004.

Third Circuit nomination under Bush[edit] On July 2, 2008, the Legal Intelligencer reported that as part of a package of judicial nominees, President Bush had agreed to withdraw his then nominee to the U.S. Court of Appeals for the Third Circuit, Gene E. K. Pratter and replace her with Diamond.[2]

On July 24, 2008, President Bush formally nominated Diamond to the United States Court of Appeals for the Third Circuit, in conjunction with Pratter's withdrawal. Since Diamond was nominated after July 1, 2008, the unofficial start date of the Thurmond Rule during a presidential election year, no hearings were scheduled on his nomination, and the nomination was returned to Bush at the end of his term.

The “Safe Harbor” date is Monday, there is no way a court could order a recount on Friday and it be completed by Monday, in fact it probably couldn’t even begin until Monday. So unless this judge plans to toss the “Bush v. Gore” precedent completely, this case is DOA.

The shrinkage isn’t from the recount or from “found” boxes of ballots. That would be massive.

It’s from absentee ballots in the Philly area tabulated after election night.

There have been other threads about this, you don’t have to take my word for it.

Just a litle Cloward-Piven tactic to overwhelm the ability of the states to do a recount in the time available for the purpose of creating doubt and distrust of the electoral system.

That actually happened about a weeks ago, all the absentee ballots were finally added into the total.

Hillary picked up about 4,000 voters in the absentee ballots (now counted). She has picked up a grand total of 5 in the recount so far.

It’s still happening. More votes have been certified outside of Philly and Trump’s Pennsylvania margin shrunk to .7% down from .8%. The 44,000 number reflects these recent additional counts.

Reposting to all the recount threads as FYI:

ATTENTION:

Wisconsin board of elections has just posted an updated spreadsheet.

This appears to be through midnight last night (Monday night).

I see on the spreadsheet 1,746,943 now having been recounted. This is over 60% of the 2.9 million votes to be recounted.

Repeat— Wisconsin is over 60% complete in their recount.

I now see reports from Madison (Dane County) wards appearing. No significant variance from election day night results.

Some of the Milwaukee County (Milwaukee City) wards are now updating to 100% in that their absentees must have been counted and show no particular variance from election day night.

There are some freepers with better Excel skills than mine so I’ll let them do the absentee exclusions (for wards who have posted partial results pending their absentees).

My total vote count is accurate. Over 60% of the 2.9 million have been recounted. These cheeseheads are going to hit their deadline.

This is not as nefarious as it sounds. They counted a bunch of absentee ballots in Philly.

Somewhat. Finishing on time erases complaints that the EVs are not valid.

The variance in the spreadsheet from election day night is in the 10s, after 60% of the vote. 1000ths of 1% change.

The exact count . . . of 10s . . . is not pure because Milwaukee is posting partial results and counting the absentees last. Excluding Milwaukee . . . 10s. But some of Milwaukee is starting to fill in their absentees.

All is well in Wisconsin so far.

I agree.

Yeah, that’s why the initial margin of close to 70,000 shrank. Most of the absentee ballots were from the cities.

But, Jill’s asking for a hand recount of everything. That will be tough in the machine-vote precincts.

you can “hack” anything, you just need physical access to the machine

Unless there are thousands of these Russian “hackers” going from voting machine to voting machine tampering with the device, they didn’t get “hacked”
