AG Schuette files lawsuit to stop recount of Michigan's presidential election results
WDIV online ^ | 12/2/2016 | John Steckroth

LANSING, Mich. - Attorney General Bill Schuette announced Friday that he filed a lawsuit on behalf of the people of Michigan to stop a request by Green Party candidate Jill Stein to recount the state’s presidential election results by hand.

The suit asks the Michigan Court of Appeals to order the Michigan Board of Canvassers to reject the request and says that the Michigan statute authorizing recounts requires the petitioning candidate to demonstrate that she was “aggrieved” by fraud or mistake.

“Michigan voters rejected Stein’s candidacy by massive margins but her refusal to accept that state-verified result poses an expensive and risky threat to hard-working taxpayers and abuses the intent of Michigan law,” said Schuette. “We have asked the court to end the recount which Stein is pursuing in violation of Michigan laws that protect the integrity of our elections. It is inexcusable for Stein to put Michigan voters at risk of paying millions and potentially losing their voice in the Electoral College in the process.”

Schuette also filed an emergency motion with the Michigan Supreme Court asking to bypass the Court of Appeals for immediate consideration.

Why would this violate equal protection any more than an initial vote with some machines and some hand counts?

“”The court finds that Petitioner’s claim of ‘butthurt’ does not rise to a level of injury sufficient to meet the standard set by Statute.”

That be one funny statement :)

And didn’t the Trump campaign file yesterday, saying that Stein did not file properly? She didn’t have the forms notarized, I think.

“potentially losing their voice in the Electoral College in the process.”

That is the intent of the challenges in all three of the states Stein is contesting. As a Pub US Rep from Wisconsin said last night, only one county (Dane which contains Madison) is doing a hand recount and the Dems in charge there are challenging every ballot they can in the hope that they can drag it out past the cutoff date of December 13 so that the Wisconsin results can not be used in the electoral college vote on the 19th.

I agree with you. I posted the quote from the article for the benefit of those who keep asserting to others on this forum that an electoral upset is impossible. Apparently the Michigan Attorney General does not agree with them.

If a state’s EV will not count for what ever reason, then they are removed from the equation entirely. So it drops the required number of EV as well as the total received.

Where the heck are all those “journalists” and pundits who excoriated DJT over not accepting the election results??? This is a fringe candidate obviously acting as a proxy or agent provocateur to attempt what amounts to a coup.

Board of State Canvassers deadlocked 2-2 along party lines on President-elect Donald Trump’s request to block the recount from occurring."
So the recount proceeds unless a court stops it. Whether a hand or machine recount is still being debated, but most likely a hand recount.

However this does not stop the appoinbtment of Electors:
"State attorney advises Board of State Canvassers that Monday's certification of the election also certified the 16 Trump electors. "

Correct, and he wasn't blue either ... Dow High's colors were green and gold.

As I understand it, the majority of judges on the MI Supreme Court are Republican, so let’s hope sanity prevails.

“What does “ a typical jock “ mean ?”

Well, in my high school in the south decades ago, “typical jocks” hung around only with each other and the cheerleaders, often hazed us “regular” kids, just because they were bigger and stronger than us and could, were often found in the “industrial arts” classes and were almost never found in advanced classes, like calculus, advanced physics and advanced chemistry, etc. The smarter ones grew up to be insurance agents, a few went to prison, and I don’t know what happened to the rest. I don’t think many go their PhDs or had very many patents.

One guy I knew at my high school, who was a super nice guy and had none of the “typical jock” behaviors, went on to play NBA basketball for a number of years.

I was built like a pencil, weighed 120 lbs. dripping wet, and was in the elite academic program. So I was to girls kind of like a cross to a vampire.

All guys have their special "gift" with the ladies. When I was in high school, I had the gift of invisibility.

Stein is just a political prop who was no way on Earth “aggrieved” and thus has zero standing

Anyone on the Canvassing board who voted in Stein’s favor should resign or be fired.....if one’s judgment is such that thinks a 1%er is somehow “aggrieved” then that person is by definition INcompetent to hold that post

Stein actually said this today (last sentence):

http://www.cnn.com/2016/12/02/politics/michigan-attorney-general-files-suit-to-stop-recount/

Stein defended her decision to request a recount in Michigan, Wisconsin and Pennsylvania — three traditionally blue swing states that proved critical to Trump’s upset victory — in an interview with CNN’s Anderson Cooper.

“What we have are predictors that if tampering took place, it would be most likely to be discovered in the three states where we are looking,” she said on “Anderson Cooper 360.” “Unless we actually look, we would never know,” she said.

“But without having the evidence, aren’t you actually contributing, perhaps unfairly, to that lack of confidence in the system itself?” Cooper asked Stein.

“What the voting technology experts tell us is that
you cannot tell unless you’re actually counting paper votes,” she said. “And I don’t think the FBI has done that.”

Last I checked, it’s not the FBI’s jobs to canvass ballots. She also claimed that WI uses illegal voting machines. A truly special kind of stupid.
