AG Schuette files lawsuit to stop recount of Michigan's presidential election results

LANSING, Mich. - Attorney General Bill Schuette announced Friday that he filed a lawsuit on behalf of the people of Michigan to stop a request by Green Party candidate Jill Stein to recount the state’s presidential election results by hand.

The suit asks the Michigan Court of Appeals to order the Michigan Board of Canvassers to reject the request and says that the Michigan statute authorizing recounts requires the petitioning candidate to demonstrate that she was “aggrieved” by fraud or mistake.

“Michigan voters rejected Stein’s candidacy by massive margins but her refusal to accept that state-verified result poses an expensive and risky threat to hard-working taxpayers and abuses the intent of Michigan law,” said Schuette. “We have asked the court to end the recount which Stein is pursuing in violation of Michigan laws that protect the integrity of our elections. It is inexcusable for Stein to put Michigan voters at risk of paying millions and potentially losing their voice in the Electoral College in the process.”

Schuette also filed an emergency motion with the Michigan Supreme Court asking to bypass the Court of Appeals for immediate consideration.

Recounts” are never really recounts when demanded by Democrats. They are re-votes.

I was think that should read.....

Recounts” are never really recounts when demanded by Democrats. They are opportunities to remove or lose republican votes and substitute democrat votes instead.

Federal courts have no jurisdiction in a state matter. This will end at the MI State Supreme Court.

Curious as to her standing - I hate dismissals over standing, BTW - given the Green Party has disavowed her actions. Who exactly is the candidate under law, the person or the party? If the latter, Stein is a non-entity.

It varies by state. For WI, anyone who received votes has standing. MI requires that the candidate demonstrate they were ‘aggreived’ by fraud or mistakes, and PA requires a prima facie case that fraud or mistakes occurred. Simply saying, gee golly wiz, these counts look funny and Russia hacked the DNC so they might have done that here does not rise to either the MI or PA standards, IMO.

Anyone have any updates on MI Board of Election hearing? Last read they reconvened after the AG’s announcement and were hearing the Trump Team’s arguments...it seems there is still an opportunity to shut down the recount today if -long odds - one of the D’s on the Board throws the BS flag at Stein...

I’m sorry, Trump camp did not file the suit, was done by a PAC. Works for me though.
Exactly on the Bush v Gore.
My guess is they stop this mess. Wisconsin will refund the money to Stein and say they don’t have time to hand counts. Or they will make all counties do machine recount and be done with it.
