At lest it's being ignored on a case by case basis by the body that made it, not the whim of the long legged mack daddy.

The law includes the right of Congress to approve a waiver on a case by case basis

The law is apparently being followed and Trump has been told the waiver will not be a problem

It will not be ignored. Congress can pass a waiver to this law - as the text of the law, itself, indicates is an option. It isn’t used much, but when you have a particular individual that a President really wants or needs, then there has to be a way to allow practicality to overcome legalism.

FYI, I’m a lawyer - but I realize (unlike many in my profession) that the law is a tool that is supposed to be used to benefit society, not an end unto itself.
