Congress will need to repeal the law that prevents him from being Secretary of Defense, but I doubt that will be a problem.

Congress doesn't need to repeal the law. They can simply issue a waiver, instead.

Nothing in the law in question mentions a congressional waiver.

So Congress can waive laws now?

If this is not a provision of this specific law, but rather a general assertion of power, this is going to be tied up in the courts for years.

Does anybody here actually know the facts?
