Anti-Trump Forces Planning 'All Out' Legal Assault on Electoral College (lawsuits in 29 states)

Anti-Trump forces are apparently planning an all out legal assault on the Electoral College in a last ditch effort to keep Donald Trump from taking office in the White House. The plan? To file legal action in all 29 states which have laws that prohibit electors from “voting their conscience.” In other words, laws that prevent electors from going against the state’s popular vote.

The inside scoop on what is being planned:

Leaders of the effort, mainly Democrats, have plans to challenge laws in the 29 states that force electors to support their party’s candidate. Those laws have never been tested, leaving some constitutional experts to argue they’re in conflict with the founders’ intention to establish a body that can evaluate the fitness of candidates for office and vote accordingly.

They’d still have to get 37 Republican electors to turn against Trump to have an impact on the election outcome. That’s going to be a tough task especially because there have been few reports that Republican electors are willing to abandon their party to vote against Trump. Sources said they will also have a coalition of lawyers that will be ready to defend (for free) anyone who votes in opposition to their party’s candidate when then the Electoral College meets on December 19.

Last week, Lawrence Lessig, a well-known professor of law at Harvard University and a political activist, penned an opinion piece in The Washington Post encouraging electors to cast their votes for Clinton despite Trump winning more votes in the Electoral College. His theory is that, while it has never been tested like this, the Electoral College is a “safety valve” that is intended “to confirm — or not — the people’s choice.

Other legal scholars believe that if the Electoral College abandons Trump, it may go against the rule of law. “Turning the electors into mighty platonic guardians doesn’t seem to be the right way to go,” UC Irvine Law Professor Rick Hasen wrote in a Friday blog post.

“So yes, I’d love to get rid of the Electoral College,” he wrote. “But not ignore it in an election where everyone agreed it was the set of rules to use.” LawNewz.com will follow this legal effort closely, and update you on this website.

My belief is that the original intention was for each Electoral Vote to represent the will of a Congressional District. The two Electoral Votes for Senators from each state was to represent the will of the state legislatures.

After all the 17th Amendment is the game changer. Senators used to represent the will of each state and were elected by the legislatures, or appointed by the Governor of each state. With the 17th Amendment came the direct election of Senators and the advent of deep pockets funding Senator’s elections and them being beholding to their financial supporters.

This is one reason so many want to repeal the 17th Amendment.

If each member of the Electoral Congress came from each Congressional District and voted the will expressed by the voters in their district, Presidential Elections would change dramatically.

No large urban district, where shenanigans can take place easily (voter fraud, and mass partisan actions), would be able to nullify the will of the rest of the Congressional Districts. There would be no 55 Electoral Votes in California all going to one candidate.

Presidential Candidates would have to run a nationwide campaign, since just going to large urban areas such as in California, the Northeast, Illinois, and Florida would not result in a Winner Take All Scenario, as it does now.

We would see the will of voters clearly stated. In most cases the party holding the White House would be in most cases, the same as the majority in the House of Representative, except when the candidate was more dynamic, or had failed to live up to the promises given the voters in a previous election.

Yes — you’re right. I believe the biggest change is that the House has to select one of the top two candidates from the Electoral College, not the top five. That’s a pretty academic point right now because it’s rare for more than two candidates to receive electoral votes these days.

Agree. The Electors have long since become an anachronism. Keep the electoral votes, but abolish the Electoral College.

This is regarding the original Electoral College (Article II, Section 1, Clause 3). James Madison said he expected the Presidential election under this system to end up in the House "nineteen times out of twenty." The two-party system destabilized this system and the 12th Amendment established a new Electoral College.

You kinda gotta feel sorry for these people, trying to generate a maelstrom and unable to do so.

They tried to make the KKK something we should all be in terror of. They sent protestors out that we all watch them on TV and pity them their anger. They got that awful Jill Stein woman, awful, awful woman....along with Bernie Sanders, both paid off, but they bribed and cajoled and paid $15 an hour to protest.

Now whatever the hell THIS thing is, filing a gazillion lawsuits.

This is all to keep fomenting the election, to keep America-and the rest of the world I must add- thinking that they are most very angry about Trump as next president.

But heh, the Carrier people are staying, and almost best of all, the thing that really makes me smile....I LOVE TRUMP AND HIS TWEETS!!!

These are people just doing whatever to keep the world and most of the idiots in this country believing we are just so unhappy with Trump, with our electoral system.

And up and coming we have the Christmas season and no one shall pay attention to them. After the first of the year everyone will look puzzled and ask where did these people come from?

Yes, it’s getting close to pathetic.

Meanwhile, I’m hearing millions planning on showing up at inauguration.
