To: Gay State Conservative

Depends on jurisdiction. Where did the crime happen? On or off post. Maybe, where was the conspiracy to commit the murder hatched? The Staff Judge Advocate (Army lawyers) along with the Army Criminal Investigation Division (CID) will be in charge of the on post investigation portion of the case. I worked in SJA or Judge Advocate General’s Office (JAG as we normally referred to it) in the Criminal Law section of several assignments, both in Germany and here in the USA. Worked on a couple of death cases. Those are very intense. You simply cannot make any mistakes or allow any rock to go unturned.

Never having run afoul of the UCMJ (thanks to the protection of my Guardian Angel) I know almost nothing about courts-martial.But I always thought that a uniformed member of the Armed Forces was always "on duty",even when on leave/liberty and off post,so that any violation of the UCMJ...even when off post and on leave/liberty...could be tried by court martial.IIRC I've read that there are times when a soldier commits a crime off post the military allows civilian authorities to deal with it in their own way.But,of course,I could surely be wrong.

Also,as an aside....I've been trying to attend courts-martial at Hanscom in Massachusetts and Groton in Connecticut but cannot because I'm refused entry onto the base.Any thoughts on how I can overcome this? My record's clean (I've led a very boring life) and I know that the Rules for Court's Martial specifically state that civilians must,in most cases,be allowed to attend them.

Any help you can provide would be appreciated.
