Not sure that his executive agreement will yield a big payoff for his release. Executive Agreements always have a "non disparagement" clause that says you won't do anything to harm the company. Example:

"Executive will not disparage the Company or any of its directors, officers, agents or Executives or otherwise take any action which could reasonably be expected to adversely affect the personal or professional reputation of the Company or any of its directors, officers, agents or employees."
