Theroux did not commit treason. Lindh did. He wasn’t charged with it, but he should have been. He was fighting against American troops on behalf of an enemy force. If that isn’t treason, what is?

I've suspected all along that the U.S. government never charged him with treason because they never would have wanted that kind of case in court. There would have been a huge public battle over the legal definition of "enemies" in this case, since the U.S. never declared war on anyone. The idiocy of the whole f#%&ing "War on Terror" would have been laid bare right in a Federal courtroom.

If the U.S. government never prosecuted Jane Fonda for treason, it probably had no legal standing to prosecute Johnny bin Walker.

By international law, terrorists are illegal combatants. You don’t need to declare war against them. They hold no legal status and can be killed with prejudice and are excluded from all statutory or treaty protections.

Unfortunately, we have a government who not only affords terrorists the rights granted to legitimate warriors, they treat them as citizens. Lindh forfeited his citizenship as soon as he took up arms against our soldiers. He should be flayed and rolled in salt.
