Black men who try to avoid an encounter with Boston police by fleeing may have a legitimate reason to do so and should not be deemed suspicious according to a ruling by the Massachusetts Supreme Judicial Court.
Warren was arrested on Dec. 18, 2011, by police who were investigating a break-in in Roxbury. Police had been given a description of the suspects as three black men one wearing a red hoodie, one wearing a black hoodie and the other wearing dark clothing. An officer later spotted Warren and another man (both wearing dark clothing) walking near a park. When the officer approached the men, they ran. Warren was later arrested and searched. No contraband was found on him, but police recovered an unlicensed .22 caliber firearm in a nearby yard. Warren was charged with unlawful possession of a firearm and later convicted.
In its ruling, the court made two major findings: The justices said police didnt have the right to stop Warren in the first place, and the fact that he ran away shouldnt be used against him.
On the first point, the court said the description of the break-in suspects clothing was vague, making it impossible for police to reasonably and rationally target Warren or any other black man wearing dark clothing as a suspect. The court said the ubiquitous clothing description and the officers "hunch" wasnt enough to justify the stop.
"Lacking any information about facial features, hairstyles, skin tone, height, weight, or other physical characteristics, the victim's description 'contribute[d] nothing to the officers' ability to distinguish the defendant from any other black male' wearing dark clothes and a 'hoodie' in Roxbury."

Fantastic!!! Let’s pass a law that says black men are allowed to run from police, and the police can’t shoot a black man who is running, armed or not.
They are just being stupid
If ordered by a police officer you do what he/she is telling you to do , immediately , slowly , deliberately , without any funny or suspicious moves . You keep your hands visible at all times . You do NOT go for your pockets or your belt at any time .
These fools start doing goofy stuff , and they get shot .
It’s their own damn fault .
Support the cops !
sounds like Obama’s rules of engagement ; placed upon our troops in Afghanistan , re: the Taliban
Karma will be if these justices meet up with a gun toting thug who has fled from the police. However, I bet all of them live and travel only in protected circumstances and probably with armed guards.
Basically this is what BLM wants. I believe that have sort of thing listed on their website.
Thank you, sir!
Now: be on yer waaaay. Nuffin’ t’ see haehrrr! G’wahn!

Right. It’s because they have ZERO respect for authority. They are raised in an atmosphere where submitting to someone with authority is like showing weakness. They will always be this way.
Maybe just stop policing the black community in general? Let it police itself. Withdraw from it.
Warrants and unpaid child support apparently motivates a lot of it.
Yeah, cuz they’re guilty and carrying.
This judge should be removed from the bench.
He has shown himself to be prejudiced against the police.
How do they do their job judge? Good grief what a moron.

If blacks truly don’t want police, then withdraw.
I could imagine a situation in which we do “red lining”, and police just stay out of certain areas. Draw a red line around the south side of Chicago, and other ghettos, and announce that we do not send police into these areas.
A legal and legitimate way to accomplish this, could be for the south side of Chicago, and ghettos of other cities, to vote to secede from their cities. Have a referendum among the people there. Vote to secede from Chicago and other cities. Establish your own segregated city government, school system, police force if you choose to have a police force, etc.
You have always had the right to flee any one that tries to detain you. Ask any 2 year old. The court didn’t take away the police officers right to pursue and hogtied their ignorant asses and detain them as long as it takes to check the probable cause you gave them.
Perfect solution. There will be collateral damage though.
Iirc:
This is not the first time a court in MA has ruled thus. About 25 years ago, it was determined that, in and of itself, flight did not amount to P.C.
It could amount to reasonable suspicion if there were articulable facts that supported the stop.
This court...without reading more....seems to have kicked that ball down that troad a little more.
Yep, our President,BLM, our making it so Police will be terrified of prosecution if they dare stop any black person for any reason, any crime, even if they shoot someone right in front of the Police. They are intimidating other people with the riots, cities, leaders, with their animalistic behavior.
It will become the norm even more so if Hillary gets in- for blacks to drag whites in the streets, parking lots, etc.
One level of insanity after the other.
If the police stop policing there will come a tipping point. At which time militias will start policing. With effective but very ugly results.
No due process. Lots of innocents caught up in the meat grinder.
If the population ratios were around even I would expect whites to just lie down and go the way of the now hyper racist South Africa. But they are not. So my prediction will be a black genocide if we don’t rein this in.
I don’t want to live in either world. Wouldn’t it be great if we could all just get along?
