I’m no attorney, but something that has puzzled me about this entire episode is that I know that in the military personnel who handle classified correspondence have an affirmative responsibility to safeguard that correspondence from any sort of compromise. Never even heard any blather about “intent” to compromise, or not. The responsibility was to follow the prescribed procedures to prevent any compromise. Failure to do so carried punishments that could be pretty severe.
It’s hard to believe that government officials do not also have an affirmative responsibility to handle classified material as prescribed, and that failure to do so is, and should be, punishable and intent should have nothing to do with it.
Sadly true - I had such hopes for Trey, and then he started showing his true colors with the Benghazi investigation that went nowhere slow, and then endorsing Rubio really iced it.
Intent is shown by state of mind and by prior acts. If we asked every criminal did they have criminal intent, the answer would always lead to no prosecution.
One other thing, one of the actual statutes did NOT require a showing of actual intent....reckless disregard would have easily met the standard for prosecution that is if the INTENT of the prosecution was to bring one. Obviously it was not.

I am of the opinion, that they just let her go. The FBI know what is going on and the way to defeat her is let her lose to Trump. How fitting that would be rejected twice from the American people!
