DOJ Admits It Really Messed Up Landmark Immigration Case

Lawyers at the U.S. Department of Justice (DOJ) concede that substantive errors were made in the legal challenge to President Obama’s executive immigration action.

The errors include inaccurate information disclosed by DOJ lawyers in the early stages of the challenge brought by 26 states to a U.S. Department of Homeland Security (DHS) order extending work permits and renewable legal status to four million undocumented immigrants. Government lawyers told U.S. District Court Judge Andrew Hanen late in 2014 that they would not begin granting deportation deferrals under the program until February 2015 — in fact, the Department issued 100,000 deferrals beginning in November 2014.

Hanen was apoplectic when the deferrals were disclosed, accusing DHS of brazen obstruction and ordering thousands of government lawyers to undergo ethics training. (RELATED: DOJ Defies Federal Judge To Protect White House’s Amnesty)

In court filings released Monday, the DOJ denied intentionally misleading the court, but concede it made a serious mistake.

“We do not dispute that we made mistakes that led to unfortunate circumstances here: at critical times we provided incomplete information to the Court because of our failure to appreciate the scope of the questions asked of us; and we used imprecise terminology in our oral and written submissions to the Court,” the brief reads.

“As a result, our submissions left the Court with an incorrect understanding of the facts regarding grants by the Department of Homeland Security (‘DHS’) of three-year terms of deferred action to individuals qualifying under the 2012 Deferred Action for Childhood Arrival (‘DACA’) eligibility criteria,” it continues. “We acknowledge and apologize for these mistakes, and for the valuable time the Court has expended on this matter as a result.”

In an attempt to appease Hanen, all attorneys in the DOJ’s Civil Division will sit for a one hour training course in ethics and professional responsibility, announced Principal Deputy Assistant Attorney General Benjamin Mizer.

Obama “messed up” when he decided he would make up his own laws and implement the DREAM Act that was not an Act because it never passed Congress.
Presidents cannot legalize illegal aliens.
When he started to do that in July 2012, with DACA, the GOP should have hauled him into court the next day.
They did not because they wanted him to legaize illegal aliens.
When he expanded that illegal amnesty for illegal aliens to include the parents of the recently amnestied, the states stepped up and sued him because the worthless opposition party would not.
DAPA, Obama’s SECOND illegal amnesty for illegal aliens is what has been stopped.
He is still legalizing illegal aliens under DACA.

In May, Judge Andrew Hanen of the U.S. District Court for the Southern District of Texas said DOJ lawyers intentionally misled him while the DACA immigration lawsuit against the Obama admin was before him in its early stages -- accusing the DOJ of a "calculated plan of unethical conduct."

Hanen said both he and opposing counsel were assured that the government would not start implementing an expansion of the immigration program until Feb. 18, 2015, but the government implemented a part of the program before February and the DHS had already granted relief preventing deportation under the immigration programs to more than 100,000 illegal immigrants while the programs were being challenged in court. Hanen accused DOJ lawyers of deliberately hiding the facts.

Normally I follow the adage that says to never assign to malice that which can be explained by incompetence. But in the case of the Obama machine, although incompetence is always present, there is more than sufficient cause to see malice at work.

We are ruled by malicious incompetents. The government lawyers ‘failed to understand the scope of the questions’ they were asked because of their breathtaking arrogance. The lack of resistance to date by either the legislative or judicial ‘co-equal’ (/s) branches to the implementation of their imperious program of conquest has made them complacent. They never considered that the judge would call them on it and push back.

One lonely Federal judge guarding his perogatives has set them on their wallets. Imagine what would be accomplished if the press, the Congress and the rest of the judiciary would do their jobs too.

But rest assured, if President Trump is sworn in, you can bet your life that the media and Congressional lions will immediately rediscover their “sacred” duties to challenge, limit and shape the limits of executive power.
