Will electors to the Electoral College be free to vote their conscience?
They always have been, since the Constitution was born, and intentionally so. I don’t know why this surprises people. There’s never been a direct election of the PotUS. We the people elect a slate of Electors to represent our state in the Electoral College - typically based on who they’ve pledged to vote for, and they elect the President...and if there’s a majority and no obvious chicanery, the House ratifies the Presidents’ and the Senate the Vice Presidents’ election. The Electors are considered part of the state election. About half of the states have laws restricting Electors...but they’ve never been enforced - and even then, they could only possibly be enforced by punishment after a contrary vote. These laws have never been Constitutionally affirmed.
As came up in the 2000 election, Congress has passed laws saying that for the Presidential election, if the rules in place in a state prior to the November election are observed, then Congress has agreed they will accept the results. Changing the rules afterwards as the courts attempted in Florida, can lead to Congress deciding what to do with the results from a state’s electoral votes - which happened several times in the 1800s.
That said, the primary delegates are considered part of the party apparatus, thus the party makes those rules.
Oh ok,....so let me see if I understand.
The judge isnt interfering with the party rules, hes saying that actual state law cant trump political party (a private entity) rules?
Is that like saying if you start a private club or group, the state laws cant subvert your club rules? I know Im dumbing it down, but thats the best way to understand it.
