President (as perhaps via Kerry) has treaty-making power only provided 2/3 of Senate concurs
it is not a treaty of the USA, it is not binding on USA at all
AND there is the second issue that a treaty cannot be used to abrogate American citizens’ constitutional rights (which if a treaty did this, would wind up having to be litigated)
but FIRST and foremost, USA is NOT bound to any “treaty” unless and until President has 2/3 Senate approval
