Doesn’t murder require premeditation? This appears to be a case of drunk driving - vehicular homicide. Still should bury the guy under the jail.

Premeditation seems surprisingly easy to establish. The driver didn’t have to get up in the morning and decide “I think I’ll go run over some cyclists today”. Coming up behind them on the road and deliberately hitting the gas instead of the brakes would be sufficient.

From my old Michigan days:

1st Degree Murder: Willful, premeditated commission of homicide with malice aforethought.

2nd Degree Murder, remove the “premeditated”.
