That may or may not be his position but he has no evidence that this particular judge is either for or against the wall, which wasn’t even an issue when the case started. Which is most likely why his lawyers haven’t gone through the proper procedure and filed a petition for reassignment.

Good point. Might explain what I consider a somewhat timid rebuttal by the Donald. He definitely needs to clear up his objection to the judge being solely because he is Mexican. I understand the press is spinning it that way to maximize the damage to Donald if any. At any rate I think that this is one fight that didn’t have to be fought. Trump can not allow the MSM to gain any sense of momentum as they attempt to destroy him at every turn.

I don't think Trump's belief that the court is biased is relevant to the order.

As for your argument that "no evidence that this particular judge is either for or against the wall, which wasn't even an issue when the case started," it might be valid, and might not. Lots has happened since the case was initiated, including, I think, a change in judge assignments to the case.

To my way of thinking, the timing and bias to be "checked" would be in light of motion to dismiss when the lead plaintiff dropped out. That was in March of this year, well after the case was filed, and well after Trump's immigration policies had wide public dissemination. It is this particular decision that has Trump riled up.

His lawyers haven't filed recusal motions, sure, and there are good reasons for that. The bar for recusal is not as low as people think.

Meanwhile, the court of public opinion will conclude whatever it chooses, both on the Trump U case, and on Curiel's bias.
