Democratic Law Prof: ‘Difficult To Imagine’ Hillary Clinton Not Being Indicted

A Democrat law professor and former Department of Justice official with decades of experience in government secrecy says “it is difficult to imagine” . Dan Metcalfe dealt with information disclosure issues for more than 25 years as Director of the Justice Department’s Office of Information and Privacy, including during the Clinton administration. He now teaches secrecy law at American University’s Washington College of Law. He wrote in a Sunday column in LawNewz that “given that the facts and law are so clear in Ms. Clinton’s case, it is difficult to imagine her not being indicted” unless the White House or a top DOJ official intervenes.

For those of us who recognized from the outset that Ms. Clinton’s exclusive use of a personal email system for all her official business (not to mention her unprecedented use of a private server atop that) was a clear violation of the Federal Records Act (‘FRA’), the findings of the State Department’s Inspector General (‘IG’) to that effect in his May 25 report were no surprise. In fact, on the admitted facts of the case, no other conclusion was possible, and it was simply another ‘shoe waiting to be dropped.’

Metcalfe describes himself as a “registered Democrat who has long said that he will vote for Hillary Clinton in November” if she gets the nomination and does not get indicted. He goes on in the column to refute Hillary’s many arguments defending her email use.

No, her self-serving email set-up was not ‘allowed’ under the State Department’s rules. No, she was not ‘permitted’ to use a personal email system exclusively as she did. No, what she did was hardly just a matter of her ‘personal convenience.’ No, there is no evidence that any State Department attorney (other than perhaps Secretary Clinton herself) ever gave ‘legal approval’ to any part of her special email system. No, everything she did was not “fully above board” or in compliance with the ‘letter and spirit of the rules,’ far from it. Yes, she was indeed required by the FRA to maintain all official emails in an official system for proper review, delineation, and retention upon her departure. Yes, her private server equipment was in fact the subject of multiple attempted intrusion attempts (i.e., hacks), including by foreign nations. The list goes on and on. (Note that this does not even include Ms. Clinton’s many serious “misstatements” about her handling of classified or potentially classified information.)

The State Department Inspector General published a report in late May saying Clinton violated agency policy by using her personal email and server, the latest sign an indictment is a serious possibility. She has been under fire for months for sending classified information over her personal email using a private server she kept in her home instead of using secure government channels. The scandal has plagued Clinton as a potential indictment hangs over her head.

See, I don't understand how these people can admit on one hand that Hillary committed crimes and continues to lie about everything and then say they will STILL vote for her. I've read two women's editorial columns lately where they are giddy with excitement over the possibility of a woman being elected POTUS. They are gung ho for Hillary even with all her baggage. Well, I think we should wait until we have a better candidate. Someone who is a role model - an admirable one - and not just glom unto Hillary because she's here now. She would be a disaster for America and would guarantee no woman EVER gets elected again. Surely there is a better woman out there to be the "first"?!

. . Getting her out of the picture changes none of the underlying moral corruption which is endemic in this country.

Some of the comments you hear people make. . the lack of education, the products of brainwashing, the ignorance, the "Watters World" responses, the PC, the moral corruption you alluded to, the talk of socialism . . . sometimes it's all very depressing, especially when you think, "They get to vote." Not to sound arrogant, but I spend and have spent my whole life, a goodly amount of time keeping up on current events, studying American History, understanding our Founding and the magnanimity of our Sacred Republic. . and these people don't know or care.

We have to reestablish our Judeo/Christian heritage, stop the invasion, establish real borders, take back the media, 'fundamentally transform' our education process and focus on the family or we are doomed as a nation.

Crime is a resume enhancement. Remember William Jefferson (D-La) was given a standing ovation by his democrat comrades when he admitted he got away with the 90,000 in bribes he had stashed in his freezer. (This was before he was busted) Hell, democrats still worship Ted Kennedy.

I think getting an indictment will help hillary with her supporters. And what better way for Obama to further poke the eye of Americans than to indict Hillary only to have no conviction, the case thrown out, or pardon her while.

Judge Napolitano said pretty much the same yesterday. he said he really expected it to have gone away by now but things have gotten really serious for Hillary and it’s so big now that even those who would protect her risk everything if they don’t acknowledge the truth.

I question the word “all”.

When talking about Bengazi, Hillary used the archaic word “cable” several times. I took it to mean some sort of incoming correspondence as all embassies communicated with State by “cable”. A cable is a message sent by intercontinental underwater cable via a Telex machine.

In today’s parlance, a cable must be something else, for instance a fax over a secure line. It might be an E mail into a secure Embassy or State Department computer. That is, a message from an ambassador to the Secretary was transmitted by a designated clerk from the embassy secure computer to a similar computer at State and received by a similar documents clerk. Such a message was in the archaic State jargon a “cable”

I suspect that official business was transmitted in such a fashion and that ambassadors did not communicate directly with Hillary be e mail for official business

It is my belief that the payouts to the members of the shadow government ate indirect. That is the Foundation sends a check to a corporation A that in turn pays corporations B and C that actually pay the various minions.

The tie to the foundation is probably offset at least once or twice
