The Zika thing truly appears to be a bunch of overblown hype intended to justify the spending of billions more taxpayer dollars. Apparently there are only around 7000 verified cases in Brazil, where it originated. A country of 200 million in the tropics.
The Court looked to the Senate rules and historical practice to determine what constitutes a “recess.” Nancy and Harry can call it a boil on their butts for all I care; the Court will look to the actual practice of the Senate. As for Senate obstruction...well, that’s a good point and might go against the Senate in a gray area. But I just read the full Noel Canning v. NLRB opinion about six weeks ago because it was an issue for the high school “We The People” team I help coach, and it seemed to me that the Court wants the President to use the confirmation process. The exercise of the power of confirmation is the sole discretion of the Senate, and the Court openly expressed reluctance to dictate Senatorial practice and procedure. Hey, they actually exercised judicial restraint and for a change found that constitutionally, it was a matter committed to another branch of government. It also appears as a matter of historical precedent that the higher the vacant office, the stronger the presumption for Senate confirmation. And there are no offices higher than judges and ambassadors, as both offices are explicitly mentioned in the Constitution as requiring the advice and consent of the Senate.

I second this. They both need to just go away - forever. Both are as disgusting as a human can be.
I don't think Obama wants to use a recess appointment here because it would take the issue off the table for the rest of the year, and Garland's term would end when the new Congress is seated. Obama thinks this is a good wedge issue, so he might be reluctant to give it up.
Of course,that also depends on some of the cases that still need to be decided. He might be willing to sacrifice a long term chance for a short term win.
I thought the Senate wasn’t going into any recess this year so Obama can’t sneak in any appointments.
