BREAKING: Obamacare Suffers Major Blow With Subsidy Payment Strikedown

A federal judge has ruled the federal government has been inappropriately paying out Obamacare subsidies, which House Republicans sued over. The lawsuit argues the Obama administration is spending money that was never allocated by Congress.

awaiting details, but without subsidies, the premiums, the deductibles, and the co-pays are out of reach for most of those using the system

Does this ruling effect the various state exchanges, or only the federal one?

I never doubt or dispute anything written by Katie Pavlich, but this will be appealed and will end up in the SCOTUS, where guess what will happen.

The judge – Bush appointee – stayed her own ruling pending Obama's appeal.

So nothing changes for the moment.

Why is Congress SUING the administration? This is a sign of total cowardice, submission and weakness.

Congress needs to find its BALLS and go straight to impeachment. THAT is the appropriate vehicle for a lawless president, not LAWSUITS.

Why are there not arrests and prosecution of government employees (president on down) when the constitution is violated or laws are broken by them? We need an order of Jedi or something, a fourth branch of govt., like the military.

...the Court has not changed its mind. While it is true that the Secretaries’ defense in this case requires interpreting federal statutes, the House of representatives’ claim under the Appropriations Clause does not. See U.S. Const. art. I, § 9, cl. 7 (“No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law.”). Instead, the interpretation of a federal statute only becomes necessary when a defendant raises such a statute as a defense. Such a defense does not turn a constitutional claim into a statutory dispute. The House’s injury depends on the Constitution and not on the U.S. Code. The Secretaries’ standing argument will be denied.

IV. CONCLUSION The Court will grant summary judgment to the House of Representatives and enter judgment in its favor. The Court will also enjoin any further reimbursements under Section 1402 until a valid appropriation is in place. However, the Court will stay its injunction pending any appeal by the parties. A memorializing Order accompanies this Opinion.

The problem is that the appellate judges are political animals.

Most federal judges are rejects from the DOJ and thus beholding to their administration masters.
