I think the biggest question is whether or not Ted’s mother gave up her citizenship while in Britain. If in fact she did, as post 38 implies, then Cruz would be British, Not American.

“We have been unifying this party. Five of those 17 candidates have endorsed our campaign. And different parts of the party. We’ve been unifying fiscal conservatives. Evangelicals. Young people. Do you know that Ted has been winning the millennial vote in state after state? He’s been winning the women’s vote in state after state. Ted is an immigrant. He is Hispanic. He can unify this party. We have libertarians joining our cause. I have people everyday from the Democrat party telling that they have re-registered to vote for Ted as a Republican because they understand what he stands for and he represents American values.”

See the “Report of Death of American Citizen “ posted here:

http://www.freerepublic.com/focus/news/3410372/posts?page=112#112

At the bottom, in the notes, it says that Eleanor had a US passport and gives the number. It’s dated 1966.

So up to 1966, she was a US citizen.

The question then is, what happened in Canada in regards to Eleanor’s citizenship?

Actually it makes no difference whether or not Eleanor expatriated her own natural born U.S. citizenship before or after Ted Cruz was born with respect to his eligibility for POTUS, because the U.S. Supreme Court correctly observed no person born abroad and outside the jurisdiction of the United States could acquire natural born citizenship: United State v. Wong Kim Ark, 169 U.S. 649, 18 S.Ct. 456, 42 L.Ed. “A person born out of the jurisdiction of the United States can only become a citizen by being naturalized....” At most Ted Cruz may or may not be a naturalized U.S. citizen, but there is no possible way he can be a natural born citizen of the United States.

The only significance Eleanor’s retention or expatriation of U.S. citizenship can play now is whether or not Ted Cruz is a lawful naturalized citizen or an illegal immigrant from Canada with fraudulently obtained U.S. citizenship who is not eligible to be in the U.S. Senate.
