Immigration fight proves Supreme Court is stuck on neutral

Visiting justices from Canada's high court sat in on Monday's immigration arguments before the Supreme Court -- and after their 90-minute education in the current state of American jurisprudence, our neighbors to the north would be forgiven if they had fantasies of building a border wall of their own.

The Senate's refusal to confirm a replacement for the late Justice Antonin Scalia has left the U.S. high court evenly split and increasingly paralyzed. As the justices heard arguments about President Barack Obama's executive actions on illegal immigration, there were really only two possible results: chaos or more chaos.

Nobody disputed that the administration has the discretion to defer action on certain illegal immigrants.


And I thought that this case dealt with the separation of powers. So they are saying that President Trump will have the "discretion" to tell 11 million illegal aliens to get the heck out of Dodge?

Recipe for a disaster.

Approve any leftist wacko the left wants as a “justice” with no standards other than gender and race.

Fail to IMPEACH any and all “justices” when they screw up—as was the intention when the court was created.

Give ‘em LIFETIME tenure (’live’ being a relative term) to boot.

Exactly why the appointment of a CONSTITUTIONAL believing Justice is so important.

God save this Republic from the likes of Dana Milbank. The Federal Government lawyers marched into the Supreme Court and insisted that words mean whatever they want them to mean at any given time for whatever purposes they might wish at the moment. The logic was required because after the President declaring that he did not have the power to make illegal aliens legal, he changed his mind. Of course, he had to do this because the Congress, who have such power, refused to give him legislation that he needed.

Most likely, the President and four of the Justices of the Supreme Court will make a statement that no law can be allowed to stand in the way of anything that the President chooses to do. The other four Justices will probably vote the other way leaving a split decision. The lower court decision will stand and the President will be told that he cannot ignore the law because he doesn’t like it.

If Dana Milbank has his way, Obama would get the fifth vote that he wants on the Supreme Court and the Republic is over.

More snooty holier-than-thou critiques from the neighbours?

More subtle pressure on SCOTUS to begin using foreign precedent more than our own Constitution?

Evenly split between blindly applying the Constitution to interpret contested law and distorting the Constitution to support desired social engineering law.
